September 11, 2006 (Work Session/Recessed Meeting) <br />Page 99 <br />The Board of Commissioners for the County of Cabarrus met for an Agenda <br />Work Session and Recessed Meeting in the Multipurpose Room at the Cabarrus <br />County Governmental Center in Concord, North Carolina on Monday, September <br />11, 2006, at 3:30 p.m. <br />Present - Chairman: Robert W. Carruth <br />Vice Chairman: Joni D. Juba <br />Commissioners: Carolyn B. Carpenter <br />Robert M. Freeman <br />Coy C. Privette <br />Also present were John D. Day, County Manager; Richard M. Koch, County <br />Attorney; Frankie F. Bonds, Clerk to the Board; and Kay Honeycutt, Deputy <br />Clerk to the Board. <br />Chairman Carruth called the meeting to order at 3:50 p.m. and observed <br />a moment of silence in remembrance of the fifth anniversary of September 11. <br />Commissioner Freeman gave the invocation. <br />Approval of Agenda <br />Vice Chairman Juba and Commissioner Privette were not present for the <br />beginning of the meeting. <br />UPON MOTION of Commissioner Freeman, seconded by Commissioner <br />Carpenter, with Chairman Carruth and Commissioners Carpenter and Freeman <br />voting for, the Board approved the Agenda as submitted. <br />Cabarrus County Sheriff' s Office and Detention Center - GNIP #1 Jail Annex - <br />Change Orders No. 1, 3, 4, 5 and 7 <br />Mike Downs, Deputy County Manager, reviewed Change Orders No. 1, 3, 4, <br />5 and 7 totaling $102,360.53. He reported the changes orders are required by <br />State regulatory agencies and/or the City of Concord. He pointed out the <br />City's Development Services Department would not review the plans <br />concurrently while the County was going through zoning approval and some of <br />the changes required by the City were made after the County approved Turner's <br />plans. <br />The change orders were as follows: <br />No. 1 - Additional landscaping fabric was required by the State Erosion <br />Control inspector for the Sediment Basin No. 1. Total 954.97. <br />No. 3 - City Engineers required a seepage trench to be designed and <br />constructed to provide additional erosion control measures should there be a <br />breach in Sediment Basin No. 2. Total $27,367.31. <br />No. 4 - The City Fire Department required vehicular access to all sides <br />of the housing facility. An approved retaining wall had to be redesigned and <br />extended an additional 98 feet. This wall is necessary to support the <br />construction of the new access/maintenance road. Total $64,601.90. <br />No. 5 - Trigon Engineering, the County's independent engineer, found <br />unsuitable soil in an area that will support a large storm drain pipe. These <br />soils were removed and replaced with soil that can support the weight of the <br />pipe and avoid maintenance problems in the future. Total $1,053.56. <br />No. 7 - In order to repair the pre-existing failure of a stormwater <br />collection system, the State Erosion Control inspector required the <br />replacement of a manhole and repair of existing pipes leading into the. <br />manhole. Total $8,382.79. <br />No. 8 was removed for further discussion with the contractor and <br />architect. <br />Mr. Downs reported the change orders add an additional 30 days onto <br />Turner's completion date with an additional 38 days up for further <br />discussion. <br />Vice Chairman Juba arrived at 9:00 p.m.; Commissioner Privette arrived <br />at 4:05 p.m.; and both were present for the remainder of the meeting. <br />There was a general discussion on the cost of insurance and performance <br />bonds; the County's decision to use a construction manager at risk to avoid <br />change orders and price changes; and what constitutes a legitimate change <br />order. <br />Mr. Downs also reported there will be another change order for the <br />waterline and the County is waiting on a price. He said the portion of the <br />waterline from Union Street to Shinn Street is being designed by the County <br />and the portion from Union Street to Spring Street is being designed by the <br />
