He said the County is working faster on Phase 2 and <br />comments have been received on the County's plans. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Carpenter <br />and unanimously carried, the Board voted to place GMP No. 1 - Jail Annex <br />Change Orders #l, #3, #4, #5 and #7 for the Cabarrus County Sheriff's Office <br />and Detention Center on the September 25, 2006 Agenda as a Consent Item. <br />Change Order No. 1 for Expansion of C&D Landfill - Phase 1 and Phase 2 <br />Rick Payne, Solid Waste Manager, presented Change Order No. 1 (Phase 1 <br />& 2 contracts) totaling $317,310.00 for the expansion of the C&D Landfill. <br />He reported additional costs were incurred for the following items: (1) <br />removal of municipal solid waste discovered in the entryway; (2) excavation <br />of unsuitable soil and replacement of suitable soil; and (3) discovery of an <br />AT&T right-of-way on the property line that was not included in the original <br />design. The cost incurred by Clup Brothers, Inc., the general contractor, to <br />remove the waste, haul it to a permitted facility and backfill with suitable <br />soil totaled $279,709.51. He said the engineers, Camp Dresser & McKee (CDM), <br />resigned the expansion area at no cost to the County. However, he said a <br />cost of $31,600.00 was incurred for design of additional monitoring wells <br />that were required by the State to monitor the area where the municipal solid <br />waste was found. Also, he said a 200-foot buffer was required between the <br />1993 "close down area" and the "new expansion area" for analytical testing to <br />determine possible well contamination between the two waste areas. Further, <br />he reported Concord Engineering had to do additional survey work totaling <br />$2,000.00 and AT&T required the installation of conduit to house future fiber <br />optic lines near the spillway totaling $4,000.00. <br />Mike Downs, Deputy County Manager reported CDM absorbed the redesign <br />cost for the missed right-of-way and the contractor did incur. additional <br />costs. In order to make this site workable, he said these things have to be <br />done and County staff spent several hours in negotiation with the general <br />contractor and engineers to reduce the price. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner <br />Carpenter and unanimously carried, the Board voted to place Change Order No. <br />1 totaling $317,310.00 for the expansion of the C&D Landfill on the September <br />25, 2006 Agenda as a Consent Item. <br />Department of Commerce - Chapter 3 Zoning Text Amendment <br />Jonathan Marshall, Commerce Director, reported the proposed text <br />amendment was initiated by a property owner who wants to redevelop a parcel <br />zoned Limited Commercial (LC) for a nursery/greenhouse, which is currently <br />not permitted in the LC zoning. At its August meeting, he said the Planning <br />and Zoning Commission recommended unanimously that the Board change the <br />ordinance to add a nursery/greenhouse to the list of permitted uses in the LC <br />zoning district. He reported a nursery/greenhouse was shown as permitted by <br />standards; however, there are no standards in the ordinance and the proposed <br />text amendment will correct this error. Finally, he reported a public <br />hearing is required. <br />There was a brief discussion on the size of a nursery/greenhouse, the <br />regulation of small retail establishments and bona fide agricultural uses <br />such as Baucom's Nursery are exempt from County zoning. <br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Juba <br />and unanimously carried, the Board scheduled a public hearing for a proposed <br />text amendment to Chapter 3 of the Cabarrus County Zoning Ordinance on <br />September 25, 2006 at 6:30 p.m. <br />Consent Agreement - Sapphire Hills Townhome Subdivision <br />Kassie Goodson Watts, Planner, presented a Consent Agreement for the <br />Sapphire Hills Townhome Subdivision. She reported the subdivision, developed <br />by JBC Development LLC, was approved by the Concord Planning and Zoning Board <br />on May 16, 2006, and consists of 60 multifamily townhome lots on 11.59 acres <br />located on Small Avenue. She said the Consent Agreement provides for the <br />advancement of adequacy at $1,331.00 per lot that will be due at final <br />platting and a build out schedule of all 60 lots platted in 2007. <br />In response to questions from the Board, Ms. Watts reported the schools <br />affected by the Sapphire Hills subdivision are currently functioning at the <br />following capacity: Weddington Hills Elementary - 110.5 percent; Concord <br />Middle School - 97.57 percent; and Concord High School - 79.73 percent. <br />
