<br />Retirement from the Cabarrus County Sheriff's Office
<br />David W. Griffin is retiring from the Cabarrus County Sheriff's Office
<br />on October 28, 2006.
<br />UPON MOTION of Commissioner Privette, seconded by Commissioner
<br />Carpenter and unanimously carried, the Board, pursuant to N.C. General
<br />Statute 20-187.2, declared surplus and authorized the award of the service
<br />weapon (Sig, 40 Caliber, Model P226R, Serial #U684262) for the price of $1.00
<br />to David W. Griffin on his retirement from the Cabarrus County Sheriff's
<br />Office.
<br />(F-2) Cabarrus County Sheriff's Office and Detention Center GMP (Guaranteed
<br />Maximum Price) #1 (Jail Annex) - Change Order Requests 1, 3, 4, 5 and 7,
<br />Totaling $102,361.00 and Related Budget Amendment
<br />Commissioner Privette reported the County hired Turner Construction
<br />Company to be the Construction Manager at Risk for the Sheriff's Office and
<br />Detention Center for a Guaranteed Maximum Price (GMP). He commented on the
<br />number of change orders submitted by Turner and said these costs should have
<br />been included in the GMP. He also commented on the overall increase in
<br />project costs for the jail and stated his intent to vote against the change
<br />order request. Further, he commented on the use of a competitive bid process
<br />to build schools without change orders in the past.
<br />John Day, County Manager, reported this request was thoroughly
<br />discussed at the September agenda work session and the change orders resulted
<br />from changes in the scope of the project due to regulations imposed by the
<br />City of Concord and the State of North Carolina. He said the changes are
<br />outside the scope of the original contract and therefore were unanticipated.
<br />He said these conditions were explained prior to entering into the
<br />Construction Manager at Risk contract and if the Board does not approve the
<br />change orders, the City of Concord will revoke the County's permits.
<br />Commissioner Privette stated it is Turner's responsibility to know the
<br />regulations and should be required to pay the cost of the change orders.
<br />UPON MOTION of Vice Chairman Juba, seconded by Chairman Carruth, with
<br />Chairman Carruth, Vice Chairman Juba and Commissioner Carpenter voting for
<br />and Commissioners Freeman and Privette voting against, the Board approved GMP
<br />Change Order No. 1 (COR's No. 1, 3, 4, 5, and 7) totaling $102,361.00;
<br />authorized the County Manager to execute and process the change order
<br />requests. Further, the Board adopted the following budget amendment:
