October 9, 2006 (Work Session/Recessed Meeting) Page 128 <br />The Board of Commissioners for the County of Cabarrus met for an Agenda <br />Work Session/Recessed Meeting in the Multipurpose Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina on Monday, October 9, 2006, at <br />3:30 p.m. <br />Present - Chairman: Robert W. Carruth <br />Vice Chairman: Joni D. Juba <br />Commissioners: Carolyn B. Carpenter <br />Robert M. Freeman <br />Coy P. Privette <br />Also present were John D. Day, County Manager; Richard M. Koch, County <br />Attorney; Frankie F. Bonds, Clerk to the Board; and Kay Honeycutt, Deputy <br />Clerk to the Board. <br />Chairman Carruth called the meeting to order at 3:38 p.m. <br />Richard M. Koch, County Attorney, was not present for the beginning of <br />the meeting. <br />Commissioner Privette gave the invocation. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman <br />and unanimously carried, the Board approved the Agenda as submitted. <br />Cabarrus County Sheriff's Department and Detention Facility Annex <br />Building/Site Work Change Order Request <br />Mike Downs, Deputy County Manager, reported Turner Construction has <br />found a tremendous amount of debris (concrete, brick, steel, rebar, tires, <br />pvc pipes, etc.) as they were clearing the site for construction. After <br />distributing several pictures of the site, he reported the material is <br />located in the middle of the retaining walls for the Annex, the housing unit <br />and possibly the back of the parking lot. He requested approval of a Change <br />Order for a "not to exceed amount" of $60,917.79 for removal of approximately <br />500 loads of unsuitable material. He said work cannot continue on this <br />project until the debris is removed and it appears the property was being <br />used as landfill, especially where the elevation drops off. <br />Scott Milligan, with Turner Construction, reported a vein measuring 80 <br />to 100 feet long by 12 feet wide was discovered, the end of the vein has not <br />been found and the vein is covered with approximately 6 feet of backfill. <br />John Day, County Manager, pointed out that removal of unsuitable soil <br />is listed as Exclusion No. 4 on the Clarifications and Assumptions exhibit <br />for the Cabarrus Detention Center and Sheriff's Department Amendment No. 1 to <br />GMP - Sitework & Annex Building. <br />Mr. Downs reported the County will only be billed for loads of debris <br />that are removed; Trigon Engineering, the third party engineer and the <br />Landfill are tracking each load; the cost is $97.00 per load; and tipping <br />fees are not being charged. <br />Commissioner Privette made a motion to place this item on the October <br />30, 2006 Agenda. <br />Chairman Carruth pointed out this meeting is a recessed meeting. <br />Commissioner Privette commented on the concept of not voting on items <br />of business at Agenda Work Sessions. <br />Commissioner Carpenter commented on the importance of keeping the <br />construction of the Annex on track and pointed out that a majority of the <br />debris is located on the Annex side of the project. <br />Mr. Day reported construction on the Annex has stopped and that a <br />change order is needed before work can proceed. <br />Commissioner Privette's motion died for lack of a second. <br />Vice Chairman Juba made a motion to approve Change Order Request No. <br />COR-013 PCO 31, totaling $60,917.79 as presented. <br />Commissioner Carpenter seconded the motion. <br />
