December 18, 2006 (Regular Meeting) Page 206 <br />WHEREAS, it costs the local taxpayers of Cabarrus County upwards of <br />$200,000 to meet the State mandated requirements of the Food and Lodging <br />Program, and <br />WHEREAS, the Cabarrus Health Alliance Food and Lodging Program has been <br />100 percent compliant with the State mandate for the past four years, and <br />WHEREAS, Local Health Departments fully support holding the State <br />Environmental Health. Division harmless for the funding to develop and <br />maintain the environmental health data system; and <br />WHEREAS, the Cabarrus County Board of Commissioners believes fee for <br />service funding for Food and Lodging support and inspections would be a more <br />equitable than asking county residents to bear the cost of this State <br />mandated service through the use of ad valorem taxes; and <br />WHEREAS, other State mandated services such as the On-Site Sewage <br />Program are funded using a fee for service approach; and <br />WHEREAS, Food and Lodging facility owners and operators are the ones <br />who draw financial benefit from such facilities; <br />THEREFORE, the Cabarrus County Board of Commissioners, meeting in <br />regular session, hereby requests the General Assembly to enact legislation <br />empowering local government to enact and collect fees for providing Food and <br />Lodging support and inspections from such enterprises operating within their <br />boundaries. <br />This the 18th day of December, 2006. <br />/s/ Robert W. No. 2006-32 <br />JOINT RESOLUTION OF THE CITY COUNCIL OF THE CITY OF KANNAPOLIS, NORTH <br />CAROLINA, AND THE BOARD OF COMISSIONERS OF CABARRUS COUNTY, NORTH CAROLINA, <br />OF SUPPORT FOR THE NORTH CAROLINA RESEARCH CAMPUS <br />WHEREAS, the City of Kannapolis, North Carolina (the "City") is a <br />municipal corporation duly organized and validly existing under the laws of <br />the Statue of North Carolina; and <br />WHEREAS, Cabarrus County, North Carolina (the "County") is a political <br />subdivision and a county created and existing under the laws of the State of <br />North Carolina; and <br />WHEREAS, pursuant to Section 158-7.3 of the General Statutes of North <br />Carolina, as amended (the "Development District Act"), the cities and <br />counties of the State of North Carolina are authorized to define a <br />development financing district and to finance public improvements that are <br />part of a development project with the proceeds of project development <br />financing debt instruments, issued pursuant to Article 6 of Chapter 159 of <br />the General Statutes of the State of North Carolina, as amended (the "Bond <br />Act"); and <br />WHEREAS, Castleand Cook, Inc., is undertaking a development project, <br />located entirely within the City, known as the North Carolina Research Campus <br />(the "Development Project") and has advised the City and the County that the <br />
