<br />Mr. Hartsell reported that the billing for his firm included services
<br />related to tax appeals, the Pillowtex bankruptcy litigation, the water
<br />litigation, Systel litigation and miscellaneous routine items.
<br />
<br />There was discussion regarding the various legal fees, specifically the
<br />approximately $75,000.00 that had been paid to Adams, Hendon Carson & Crow
<br />for the water litigation with the City of Concord, and the status of that
<br />pending litigation with Concord. It was noted during discussion that the
<br />legal expenses had decreased since December 20, 2004.
<br />
<br />UPON MOTION of vice Chairman Carruth, seconded by Commissioner Juba
<br />with Chairman Carpenter, Vice Chairman Carruth and Commissioners Freeman and
<br />Juba voting for and Commissioner Privette voting against, the Board adopted
<br />the following budget amendment.

<br />TYPE OF ADJUSTMENT: Supplemental Request
<br />PURPOSE OF REQUEST: At the Board of Commissioners meeting January 24, 2005,
<br />the Board directed all costs associated with County Attorney be placed in a
<br />separate budget. This amendment establishes budgets for Dues & Subscriptions
<br />and increases Legal Fees based on current activity levels.

<br />Subdivision (Formerly Consent Item F-2)

<br />Vice Chairman Carruth stated the Laureldale Subdivision was also in the
<br />vicinity of the Odell School area and questioned the adequacy contribution of
<br />$1,008.00.
<br />
<br />Jonathan Marshall, Director of Commerce, reported the Laureldale
<br />development was approved by the Concord Planning and Zoning Commission on
<br />January 18, 2005. He stated the subdivision was submitted when the policy
<br />for the advancement of school adequacy was set at $1,008.00.
<br />
<br />UPON MOTION of Vice Chairman Carruth, seconded by Commissioner Privette
<br />and unanimously carried, the Board tabled the Consent Agreement with Pulte
<br />Home Corporation for the Laureldale Subdivision until April 18, 2005.

<br />CODDllission's February 17th Denial of the Wellington Chase Subdivision C05-

<br />
<br />Jonathan Marshall, Commerce Director, introduced discussion regarding
<br />the Wellington Chase Subdivision and issues associated with the adequate
<br />public facilities ordinance. The following items were included in the Agenda
<br />package that was provided to the Board:
