<br />May 23, 2005 - Regular Meeting <br /> <br />Page <br /> <br />189 <br /> <br />There was no one to address the Board, and Chairman Carpenter closed <br />the public hearing at 9:42 p.m. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Juba and <br />unanimously carried, the Board adopted the following ordinance as amended <br />with the provision that no outside storage of construction equipment over <br />10,000 pounds is permitted. <br /> <br />Ordinance No. 2005-03 <br /> <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br /> <br />Change Chapter 7, Performance Based Standards, Section 7-4 - Uses Permitted <br />Based on Standards (PBS) , Item Number 45 as follows (bold print indicates <br />changes/additions) : <br /> <br />45. Contractor and Trade Shops <br /> <br />Zones permitted based on standards: <br /> <br />Office/Limited Commercial, Agricultural/open <br /> <br />Standards: <br /> <br />A) Site Plan. An approved site plan as described in Part I, Chapter 12, if <br />required <br />B) Maximum square footage. Shall not exceed 10,000 square feet for all <br />enclosed structures. <br />C) Outside storage. All outside storage areas including dumpsters must <br />be: <br />- sited behind the rear wall of the building; <br />- within the required setbacks of the zoning district that the <br />use is located in, and outside any required buffer yard; <br />- enclosed with a fence that is at least 6 feet high; <br />- screened from adjacent properties, and from public and private <br />rights-of-way with a level 2 buffer yard; <br />- the outdoor storage area may not exceed 10,000 square feet; <br />- no storage of large construction vehicles is permitted (large <br />construction vehicles means any vehicle with a gross weight in <br />excess of 10,000 lbs.) <br />- Outside storage areas shall be located at least 50 feet from <br />adjacent property lines. <br /> <br />D) Location. In the Agricultural/Open district only, uses shall only be <br />permitted on major thoroughfares. In addition, such use may not be <br />located in any watershed protection area. <br /> <br />E) Landscaping. Uses shall meet all applicable landscaping standards in <br />Chapter 9 of the Zoning Ordinance. When occupying an existing <br />structure landscaping shall be upgraded to meet these requirements. <br /> <br />F) Size of Property. The minimum property size shall be 2 acres (AO zone <br />only) . <br /> <br />Adopted this the 23rd day of May, 2005 by the Cabarrus County Board of <br />Commissioners. <br /> <br />ATTEST: <br />/s/ Frankie F. Carpenter, Chairman <br />Cabarrus County Board of Commissioners <br /> <br />to the Board <br /> <br />(G-7) Countywide Zoning Map Amendment COS-04 (R) and Proposed New Zoning <br />Districts - Public Hearing - 6:30 p.m. <br /> <br />Rodger Lentz, Planning and Zoning Manager, . presented the proposed new <br />zoning map for Cabarrus County's planning jurisdictions as a part of the <br />Deigning CaharruB process. In addition, th~ following two new zoning <br />districts are proposed: (1) Office-Institutional to preserve land for <br />economic development purposes; and (2) Manufactured Housing Overlay Zone - to <br />permit manufactured housing in certain areas of CaharruB County. Mr. Lentz <br />recommended that the Board hold the public hearing I but defer adoption of the <br />map until the June 20th meeting when the map and standards can be adopted <br />together. <br />
