<br />September 29, 2005 - Recessed Meeting <br /> <br />Page <br /> <br />341 <br /> <br />The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Multipurpose Room at the Cabarrus County Governmental Center <br />in Concord, North Carolina on Thursday, September 29, 2005, at 6:00 p.m. <br /> <br />Present - Chairman: Carolyn B. Carpenter <br />Vice Chairman: Robert W. Carruth <br />Commissioners: Robert M. Freeman <br />Joni D. Juba <br />Coy C. Privette <br /> <br />Also present were John D. Day, County Managerj <br />Jr., County Attorney; Frankie F. Bonds, Clerk to <br />Honeycutt, Deputy Clerk to the Board. <br /> <br />Fletcher L. <br />the Board; <br /> <br />Hartsell, <br />and Kay <br /> <br />Chairman Carpenter called the recessed meeting to order at 6:06 p.m. <br /> <br />commissioner Privette gave the invocation. <br /> <br />County Attorney Selection Committee Report <br /> <br /> <br />Chairman Carpenter reported the County Attorney Selection Committee met <br />earlier this date and discussed such issues as qualifications, individual <br />versus law firm, residency requirements, etc. She said the Committee agreed <br />to advertise the position locally as well as with the N. C. Association of <br />County Commissioners (NCACC) and to accept applications for a period of one <br />week. Finally, Chairman Carpenter reported the Committee had voted to <br />recommend that the current County Attorney appointment be extended until <br />October 31. <br /> <br />Commissioner Privette made a motion, seconded by Commissioner Freeman, <br />to adopt the Committee's recommendation to extend the current County Attorney <br />appointment until October 31, 2005. <br /> <br />UPON SUBSTITUTE MOTION of Chairman Carpenter, seconded by vice Chairman <br />Carruth with Chairman Carpenter, Vice Chairman Carruth and Commissioner Juba <br />voting for and Commissioners Privette and Freeman voting against, the Board <br />voted to extend the current County Attorney appointment until a replacement <br />is in place. <br /> <br />UPON MOTION of Commissioner Juba, seconded by Chairman Carpenter with <br />Commissioners Juba and Freeman, Chairman Carpenter and Vice Chairman Carruth <br />voting for and Commissioner Privette voting against, the Board voted to <br />change the application time period from one week to 30 days and asked the <br />County Manager and the County Attorney to develop the advertisement for the <br />County Attorney position. <br /> <br />After discussion, it was generally agreed for the position to be <br />advertised in THE INDEPENDENT TRIBUNE, SALISBURY POST, CONCORD STANDARD AND <br />TIMES and THE CHARLOTTE OBSERVER (Cabarrus Neighbors). Also, contact will be <br />made with NCACC concerning the possibility of posting the position on its <br />website if its publication deadline cannot be met. <br /> <br />There was also brief discussion as to whether the position should be <br />full-time or part-time and the types of services to be performed. <br /> <br />Closed Session <br /> <br />UPON MOTION of Commissioner Freeman, seconded by Vice Chairman Carruth <br />and unanimously carried, the Board moved to go into Closed Session to consult <br />with the County Attorney to preserve the attorney-client privilege and to <br />discuss pending litigation and personnel issues as authorized by NCGS 143- <br />318.11 (a) (3) (6) . <br /> <br />UPON MOTION of Vice Chairman Carruth, seconded by Commissioner Freeman <br />and unanimously carried, the Board moved to come out of Closed Session. <br /> <br />Adequate Public Facilities - Phasing of Developments <br /> <br />Chairman Carpenter recognized Jonathan Marshall, Commerce Director, for <br />a report on adequate public facilities and the pending subdivisions. <br /> <br />Mr. Marshall stated staff had met with the developers of nine pending <br />subdivisions to determine phasing for each of those developments as <br />instructed by the Board. He said the graph that was before the Board <br />reflected the proposed phasing for the subdivisions. He also reviewed the <br />status of the pending developments as follows. <br />
