The Board needs to act on that appeal <br />prior to the approval of the Consent Agreement. <br />The Enclave: Has provided build out schedule and Consent Agreement <br />has been signed. <br />Wellington Chase: County Attorney has made all contact due to <br />ongoing litigation. <br /> <br />County <br />1) <br /> <br />2) <br /> <br />4) <br /> <br />Mr. Marshall responded to a number of questions by the Board regarding <br />the phasing of developments, the process used in proj ecting build out rates <br />and the issue of school adequacy. He provided the following information: <br /> <br /> <br />1) Phasing of development allows staff to see how the building schedule <br />matches up with the school building program that is underway and <br />projected in the 15-year school facility plan, thus resulting in <br />more accurate projections. <br />2) The Waterford, Wellington Chase and Pelham pointe subdivisions were <br />submitted under the previous Subdivision and Zoning Ordinances and <br />are subj ect to those regulations and standards. The Enclave was <br />submitted after adoption of the new standards in June. The six <br />subdivisions in the City of Concord were approved by the City and <br />are before the Board for consideration of the Consent Agreement. <br />3) The projected new students, projected enrollment and available seats <br />for Cabarrus County Schools as shown on the spreadsheet were a <br />result of a meeting with the Assistant School Superintendent who <br />oversees the Schools' IS-Year Plan. <br />4) Available seats along with the growth in the number of seats based <br />on planned new school construction were factored in the projection <br />with a surplus of 370 seats reflected in 2005, a deficit of 627 <br />seats in 2006 and a surplus of 1,674 seats in 2007. <br /> <br />There was lengthy discussion regarding school adequacy and the phasing <br />of developments. The following issues were addressed: the history of allowing <br />developers to advance school adequacy; the 15-year facility plan for the <br />County Schools; on-going work by County staff with the schools on new school <br />construction; length of time from the issuance of a building permit to <br />occupancy of a home; and school adequacy in certain areas of the county as <br />compared to the entire County system. It was noted that three elementary <br />schools (i.e., one near Northwest High School, one at pitts school Road and <br />the Odell replacement school) were included in the bond referendum for <br />construction. <br /> <br />Mr. Day reported that the developers for Pelham pointe and Waterford <br />had appealed the decision of the Planning and Zoning Commission but had <br />requested that the appeal not be heard by the Board for some indefinite <br />amount of time. He stated the Board could add those appeals to the agenda <br />and the Consent Agreements for the subdivisions were among those scheduled <br />for consideration at this meeting. <br /> <br />There was discussion both for and against adding the appeals to the <br />Agenda. The discussion centered on public notice for considering the appeals <br />and the inability to consider the Consent Agreements until there is plat <br />approval. It was noted that the developers for the two subdivisions were <br />present for the meeting. <br />
