<br />September 29, 2005 - Recessed Meeting <br /> <br />Page <br /> <br />347 <br /> <br />Mr. Robbins stated plans to begin pulling permits in the fall of 2006. <br />He said it would take five or six months to construct the type of home <br />planned for the subdivision. <br /> <br />Mr. Day asked Mr. Robbins if he would agree to include a provision in <br />the Consent Agreement that no Certificates of Occupancy would be issued <br />before January 2007. The 40 building permits could be obtained in 2006. <br /> <br />Mr. Robbins agreed to the provision that no certificates of occupancy <br />would be issued before January 2007. <br /> <br />The motion by Commissioner Privette and seconded by Commissioner <br />Freeman to postpone consideration of the Consent Agreement for Waterford <br />until the Board meeting in October failed with Commissioners Privette and <br />Freeman voting for and Chairman Carpenter, Vice Chairman Carruth and <br />Commissioner Juba voting against. <br /> <br /> <br />UPON MOTION of Vice Chairman Carruth, seconded by Commissioner Juba <br />with vice Chairman Carruth, Commissioner Juba and Chairman Carpenter voting <br />for and Commissioners Privette and Freeman voting against, the Board approved <br />the Consent Agreement for the Waterford on the Rocky River subdivision with <br />the build out schedule as included in the Consent Agreement and with the <br />condition that no Certificate of Occupancy will be issued until January I, <br />2007; and granted authority to the County Manager and County Attorney to <br />finalize the Consent Agreement. <br /> <br />An amendment by Commissioner Privette, seconded by Commissioner <br />Freeman, that approval be contingent upon the Cabarrus County School Board <br />verifying there will be adequate school facilities for the students from this <br />development failed with Commissioners Privette and Freeman voting for and <br />Chairman Carpenter, vice Chairman Carruth and Commissioner Juba voting <br />against. <br /> <br />The Enclave <br /> <br />The Consent Agreement for The Enclave was presented for consideration. <br />The subdivision was submitted under the County's new standards and was <br />unanimously approved by the Planning and zoning Commission. The build out <br />schedule provided for six lots in each of the years 2006, 2007 and 2008. <br /> <br />Commissioner Privette stated it had been reported that the development <br />would not have any impact on the County Schools as the students would be <br />attending private schools. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman <br />and unanimously carried, the Board approved the Consent Agreement for The <br />Enclave as presented and authorized the County Manager and County Attorney to <br />finalize the Consent Agreement. <br /> <br />Savannah Glen and Wellspring Village <br /> <br />Chairman Carpenter made a motion, seconded by Commissioner Privette to <br />put the Consent Agreements for Savannah Glen and Wellspring village on the <br />Agenda for the October meeting and to have the County School Board Chairman <br />to come before the Board to discuss school adequacy. <br /> <br />Mr. Day reported that the Consent Agreements have not been completed as <br />the developers are proposing senior developments that would be restricted to <br />older adult residents and have no impact on the schools. He stated staff <br />continues to work with these developers. <br /> <br />Chairman Carpenter amended her motion for the Consent Agreements for <br />Savannah Glen and wellspring village to come to the Board when they are <br />completed. Vice Chairman Carruth seconded the motion and it was unanimously <br />approved. <br /> <br />Laurel Park 4-6 <br /> <br />Mr. Day reported that an agreement had not yet been reached with the <br />developer of Laurel Park 4-6. <br /> <br />The motion by Chairman Carpenter to put Laurel Park on the October <br />agenda and ask the Schools to be present for that meeting died for lack of a <br />second. <br />
