<br />November 17, 2005 - Recessed Meeting <br /> <br />Page <br /> <br />393 <br /> <br />The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Multipurpose Room at the Cabarrus County Governmental Center <br />in Concord, North Carolina on Thursday, November 17, 2005, at 2:30 p.m. <br /> <br />Present - Chairman: Carolyn B. Carpenter <br />vice Chairman: Robert W. Carruth <br />Commissioners: Robert M. Freeman <br />Joni D. Juba <br />Coy C. Privette <br /> <br />Also present were John D. Day, County Manager; Fletcher L. Hartsell, <br />Jr., County Attorney; and Frankie F. Bonds, Clerk to the Board. <br /> <br />Chairman Carpenter called the meeting to order at 2:30 p.m. <br /> <br />Commissioner Juba gave the invocation. <br /> <br />Approval of Agenda <br /> <br />The following items were presented for addition to the Agenda: Sale of <br />Property to piedmont Preservation; Update on Contract for Construction <br />Manager at Risk with Turner Construction; Award of Demolition Contract for <br />Sheriff's Office and Detention Center Project; Purchase and Sale Agreement <br />for the Former First Union Building; and Closed Session to Consult with the <br />County Attorney. <br /> <br />Chairman Carpenter asked that a Letter of Endorsement be added to the <br />Agenda for a grant application by the Cabarrus Health Alliance to the N. C. <br />Division of Public Health to fund an Adolescent Parenting Services Program. <br /> <br />UPON MOTION of Vice Chairman Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board voted to approve the addition of the items <br />as presented to the Agenda. <br /> <br />Update on Contract for Construction Manager at Risk with Turner Construction <br /> <br />John Day, County Manager, presented an update on the development of a <br />contract with Turner Construction for Construction Manager at Risk services. <br />He stated Fenton Erwin had been hired as the construction law attorney and <br />was reviewing the proposed contract, which was based on a model from the <br />State Office of Construction. Also, for comparison purposes, contracts have <br />been requested for State projects of a similar scope. Mr. Day responded to a <br />number of questions regarding the construction manager at risk delivery <br />method, including such items as project costs, fee calculation, the handling <br />of changes orders, general conditions and the calculation of the Guaranteed <br />Maximum Price. <br /> <br />Sale of Property to piedmont Preservation Foundation <br /> <br />Janet Magaldi, President of Piedmont Preservation Foundation (PPF) , <br />reported that PPF had received the Cline and Propst houses as a gift from <br />Joseph and Angela Lockavitch. She outlined the following concerns regarding <br />the proposed contract with the County for the purchase of property to <br />relocate the houses: (1) PPF's inability to draw down money from the line of <br />credit for such items as removing the chimneys and trees; (2) Deadline for <br />moving the houses. Ms. Magaldi also questioned the need for a performance <br />bond, but stated PPF had no problem in providing one if required. <br /> <br />After discussion, there was general consensus to strike the following <br />sentence from the second paragraph of Item 3 of the contract: "Buyer hereby <br />agrees not to draw any funds from any line of credit that is secured by the <br />two lots other than the purchase price." <br /> <br />Mr. Day explained the intent of the bond was to provide protection in <br />the event the houses did not make it to the new site. <br /> <br />Ms. Magaldi reported the house mover who was going to do the work had <br />gone out of business. After consulting several businesses, she had located a <br />house mover in Spartanburg, S. C. that could move the houses within the time <br />frame. She requested assistance by the County in taking down several trees <br />next to the houses and stated she had a proposal of $3,400.00 for tree <br />removal. <br /> <br />There was brief discussion regarding the removal of trees. It was noted <br />that the trees would have to be removed as part of the site preparation for <br />the new Jail. <br />
