<br />December 19, 2005 - Regular Meeting <br /> <br />Page <br /> <br />447 <br /> <br />In October 2005, the Board approved in principle a proposal by Portrait <br />Homes to sell improved property off pitts School Road to Cabarrus County at a <br />price of $1.7 million for use as an elementary school site. Portrait Homes <br />estimated the value of the land and improvements at $2,060,750.00 and <br />requested the difference in value be credited towards school adequacy <br />payments. The overall review of prices yielded a total project cost of <br />$1,970,681.00, including land, improvements, development oversight fee and <br />offsi te road improvements. Based on that amount, a Consent Agreement was <br />proposed with Portrait Homes that included a $270,681.00 credit toward school <br />adequacy payments. The total amount of the school adequacy would depend on <br />the total number of units constructed within the project and Portrait Homes <br />would be responsible for payment of any amount above $270,681.00. A Consent <br />Agreement reflecting these figures was included as a part of the Agenda. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman <br />and unanimously carried, the Board approved a Consent Agreement with Portrait <br />Homes that was included in the Agenda, including a $270,681.00 credit towards <br />school adequacy payments, subject to the review and signature by the County <br />Attorney and County Manager. <br /> <br />(G-16) Midland Communication Tower Site - Misenheimer Property <br /> <br />At its November meeting, the Board authorized the County Manager and <br />County Attorney to proceed with negotiations and execution of a contract with <br />Donald E. Misenheimer for the purchase of one acre of land and associated <br />rights-of-way at 391 Highway 24-27 East in Midland for a communications tower <br />site. The title search identified an outstanding judgment of $2,015.00 that <br />must be paid prior to the issuance of a clear deed for the property. Mr. <br />Misenheimer asked the County to increase the purchase price by $1,000.00 to <br />help him payoff the judgment. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman <br />and unanimously carried, the Board approved a revised contract in the amount <br />of $51,000.00 for the purchase of a one-acre tract of land and associated <br />rights-of-way at 391 Highway 24-27 East in Midland, NC, from Donald E. <br />Misenheimer for a communications tower site. <br /> <br />ITEM REMOVED FROM THE CONSENT AGENDA FOR DISCUSSION <br /> <br />(G-12) Cabarrus Arts Council - Authorization to Seek Sponsors for Rooms in <br />the Historic Courthouse <br /> <br />Cabarrus Arts Council, which is now located in the Historic Courthouse, <br />is looking to create more programs for the theater and exhibit space. As a <br />means to raise funds, the Council has requested permission to seek <br />sponsorships for the various rooms, such as the theater and gallery space, <br />from local corporations. The sponsorships could be for a period of one to <br />five years with a small plaque or other form of sponsor recognition. The <br />funds from the sponsorships would be used to help develop programs, such as a <br />performing arts series in the theater. <br /> <br />Commissioner Carpenter stated she had concerns with the Arts Council <br />naming the rooms in the Historic Courthouse. Further, she commented on the <br />operating expenses born by the County for a nonprofit. <br /> <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Freeman and <br />unanimously carried, the Board moved to table Item G-12 until the January <br />2006 meeting, with Commissioner Carpenter to discuss her concerns with the <br />Noelle Scott, Executive Director of the Cabarrus Arts Council. <br /> <br />(H) NEW BUSINESS <br /> <br />(H-l) FY 2007 Community Transportation Program Grant Request <br />Hearing <br /> <br />Public <br /> <br />Randy Bass, Transportation Manager, presented a brief overview of the <br />annual funding request to the North Carolina Department of Transportation to <br />assist in funding the Cabarrus County Public Transportation Program. He <br />reported the County is applying for $462,631.00 in Administrative funding, <br />$348,710.00 in Capital funding and $135,097.00 in Advanced Technology. <br /> <br />At 10:55 p.m., Chairman Carruth opened the public hearing on the FY <br />2007 Community Transportation Program Grant Funding Application. The Public <br />Hearing Notice was published in THE INDEPENDENT TRIBUNE on December 9, 2005. <br />
