Mr. Whitley does not seek <br />reappointment, having served eight years. Mr. VanGorden is completing an <br />unexpired term and is eligible for reappointment. Beth Wanke submitted an <br />application to serve as a Private Sector member. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner <br />Carpenter and unanimously carried, the Board reappointed Bob VanGorden <br />(Private Sector) and appointed Beth Wanke {Private Sector) to the Centralina <br />Workforce Development Board for terms of two years ending June 30, 2006. <br /> <br />(I) REPORTS <br /> <br />(I-1) Vacant Position Report <br /> <br /> The Vacant Position Status Report (Effective 4/5/04) as submitted by <br />Don Cummings, Human Resources Director, was included as a part of the Agenda. <br /> <br />(K) WATER & SEWER DISTRICT OF CABARRUS COIINTY - REGULAR M~ETING <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Carpenter <br />and unanimously carried, the Board recessed the meeting of the Board of <br />Commissioners at 8:54 p.m. until the conclusion of the meeting of the Water <br />and Sewer District. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board reconvened the regular meeting of the <br />Board of Commissioners at 8:55 p.m. <br /> <br />(L) CLOSED SESSION <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Carpenter <br />and unanimously carried, the Board moved to go into Closed Session to consult <br />with the County Attorney to preserve the attorney-client privilege and <br />discuss pending litigation as authorized by North Carolina General Statute <br />143-318.11(a) (3) and to prevent the disclosure of information that is <br />privileged or confidential pursuant to NCGS 143-318.10(e) as authorized by <br />NCGS 143-318.11(a) (1). The Board invited Attorney Fletcher L. Hartsell, Jr. <br />to join the Board in closed session. <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Carpenter <br />and unanimously carried, the Board moved to come out of the Closed Session at <br />11:19 p.m. <br /> <br /> John Day presented the following statement by the Board <br />Commissioners. <br /> <br /> For at least one year, County and municipal representatives have <br /> discussed the development of "transitional zoning standards" in <br /> the unincorporated areas surrounding the cities. The reasoning <br /> behind the effort was to enact development standards in those <br /> unincorporated areas of the County likely to be annexed by the <br /> municipalities that more closely match those enforced by the <br /> municipalities themselves. This would provide a greater <br /> uniformity in appearance and construction standards in those <br /> areas that would be annexed in the future, as compared to <br /> development governed solely by the municipalities within their <br /> corporate limits. <br /> <br />of <br /> <br />The City of Concord and Cabarrus County are defendants in <br />lawsuits brought by two landowners against the City of Concord and <br />Cabarrus County. The properties that are subject to the lawsuits <br />are located outside City limits and within the County's planning <br />and zoning jurisdiction. The County had given planning and <br />construction approval to one of the projects and the other has a <br />statutorily vested right to proceed based on a general <br />development plan that was submitted. <br /> <br /> <br />
