May 17, 2004 Page 474 <br /> <br /> Commissioner Carruth asked the Board to change the date of the regular <br />meeting in June. He stated he had an early morning appointment in Chicago on <br />June 22 and could not attend the meeting scheduled on June 21. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Chairman Freeman and <br />unanimously carried, the Board by resolution changed the regular meeting date <br />in June from June 21 to June 28, 2004, at 6:30 p.m. <br /> <br />(K) WATER & SEWER DISTRICT OF CABARRUS COUNTY - REGULAR MEETING <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board recessed the meeting of the Board of <br />Commissioners at 9:39 p.m. until the conclusion of the meeting of the Water <br />and Sewer District. <br /> <br /> UPON MOTION OF Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board reconvened the regular meeting of the <br />Board of Commissioners at 9:40 p.m. <br /> <br />(h) CLOSED SESSION <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />unanimously carried, the Board moved to go into Closed Session to consult <br />with the County Attorney to preserve the attorney-client privilege as <br />authorized by North Carolina General Statute (NCGS) 143-318.11(a) (3), such <br />session to include discussions regarding pending lawsuits: Craft Development <br />and Craft Homes vs. City of Concord and Cabarrus County; Robert and Mary <br />White Morrison, etc. vs. City of Concord and Cabarrus County; and Cabarrus <br />County vs. Systel Business Systems. <br /> <br /> UPON MOTION of Vice Chairman Suggs, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to come out of Closed Session. <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board invited Keith Allison, President and CEO <br />of Systel Business Systems, to join the Board in Closed Session. <br /> <br /> UPON MOTION of Vice Chairman Suggs, seconded by Commissioner Privette <br />and unanimously approved, the Board moved to return to Closed Session as <br />authorized by NCGS 143-318.11(a) (3), with Keith Allison, President and CEO of <br />Systel Business Systems, joining the Board for a portion of the Closed <br />Session. <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to come out of closed session. <br /> <br />No action was reported from the Closed Session. <br /> <br />(M) RECESS OF MEETING <br /> <br /> There being no further business to come before the Board, Chairman <br />Freeman recessed the meeting at 11:45 p.m. until 8:30 a.m. on Monday, May 24, <br />2004, in Conference Room A at the Governmental Center. <br /> <br />Clerk to the Board <br /> <br /> <br />
