<br />November 15, 2004 <br /> <br />Page <br /> <br />679 <br /> <br />commissioner Privette moved for passage of the foregoing resolution, <br />Vice Chairman Suggs seconded the motion and the resolution was passed by the <br />following vote: <br /> <br />Ayes: Commissioners Privette, Carpenter and Carruth, Vice Chairman <br />Suggs and Chairman Freeman <br /> <br />Nays: None <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Commissioner Privette then introduced the following resolution the <br />title of which was read: <br /> <br />Resolution No. 2004-44 <br /> <br />RESOLUTION CERTIFYING AND DECLARING RESULTS OF 2004 REFERENDUM ON CABARRUS <br />COUNTY GENERAL OBLIGATION COMMUNITY COLLEGE BONDS AND <br />PROVIDING FOR PUBLICATION OF NOTICE THEREOF <br /> <br />WHEREAS, the Board of Commissioners for Cabarrus County (the UBoard") <br />desires to certify and declare the results of the referendum held on November <br />2, 2004 with respect to the authorization of the proposed $3,100,000 General <br />Obligation Community College Bonds; <br /> <br />NOW, THEREFORE, the Board does the following: <br /> <br />BE IT RESOLVED by the Board of Commissioners for Cabarrus County: <br /> <br />1. The Board hereby certifies and declares the results of the <br />referendum held on November 2, 2004, with respect to the proposed $3,100,000 <br />General Obligation Community College Bonds of Cabarrus County, to be 32,220 <br />votes UFor" approval of the Bond Order and 21,316 votes UAgainst" approval of <br />the Bond Order. <br /> <br />2. This resolution shall take effect immediately. <br /> <br />Commissioner Privette moved for passage of the foregoing resolution, <br />Vice Chairman Suggs seconded the motion and the resolution was passed by the <br />following vote: <br /> <br />Ayes: Commissioners Privette, Carpenter and Carruth, Vice Chairman <br />Suggs and Chairman Freeman <br /> <br />Nays: None <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />EXHIBIT A <br /> <br />RESULT OF REFERENDUM ON $94,900,000 <br />CABARRUS COUNTY GENERAL OBLIGATION SCHOOL BONDS <br /> <br />The result of the referendum held on November 2, 2004 in Cabarrus <br />County, North Carolina (the uCounty") on the issuance by the County of <br />general obligation school bonds in an aggregate principal amount not to <br />exceed $94,900,000 for the purpose of providing funds, with any other <br />available funds, for erecting additional school buildings and other school <br />plant facilities, replacing, remodeling, enlarging and reconstructing <br />existing school buildings and other school plant facilities and acquiring any <br />necessary land, rights-of-way, furnishings and equipment therefor, including <br />computers, in order to provide such school facilities in said County as <br />required by section 2 of Article IX of the Constitution, was 33,732 votes <br />UFor" approval of the Bond Order and 21,528 votes uAgainst" approval of the <br />Bond Order adopted by the Board of said County with respect to such school <br />bonds. <br />Any action or proceeding challenging the regularity or validity of this <br />bond referendum must be begun within 30 days after November __, 2004. <br /> <br /> <br />CABARRUS COUNTY BOARD OF COMMISSIONERS <br /> <br />[Insert date of publication] <br />
