C. <br /> <br />NOW, THEREFORE, be it resolved that the County Manager of Board <br />of County Commissioners is hereby authorized to submit a grant <br />application for federal and state funding, make the necessary <br />assurances and certifications and be empowered to enter into an <br />agreement with the NCDOT to provide rural public transportation <br />services. <br /> <br />ITEMS REMOVED FROM THE CONSENT AGENDA FOR DISCUSSION <br /> <br />(E-13) Approval nunc prO tunc of Waiver of Yard Waste Disposal Fees at <br />Landfill through Jan~ar~ 31, 2003 <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board approved nunc pro tunc the waiver of yard <br />waste disposal fees at the Landfill for debris from the ice storm for the <br />period December 23, 2002 through January 31, 2003. <br /> <br />(E-14) Resolution Granting Authority to Sell Excess Fill Dirt at Arena and <br />Events Center Property <br /> <br /> Mr. Mike Downs, Public Safety Services Director, responded to questions <br />regarding the proposal to sell excess fill dirt at the Arena and Events <br />Center. He explained that the dirt had been unsuitable for construction and <br />had been moved from the construction site to an area along Highway 49. Also, <br />he commented on the cost for the County to move the dirt to the Landfill. <br /> <br /> UPON MOTION of Vice Chairman Suggs, seconded by Commissioner Privette <br />and unanimously carried, the Board adopted the following Resolution. <br /> <br />Resolution No. 2003-02 <br /> <br />STATE OF NORTH CAROLINA ) <br /> ) <br />CABARRUS COUNTY ) <br /> <br />RESOLUTION <br /> <br />WHEREAS, Cabarrus County owns certain items of personal property that have <br />become surplus for its current needs: and <br /> <br />WHEREAS, North Carolina General Statute 160A-266 permits the County to sell <br />such property by private sale, upon authorization by the Board of <br />Commissioners at a regular meeting and notice to the public; and <br /> <br />WHEREAS, the Board of Commissioners is convened in a regular meeting; <br /> <br />THEREFORE, THE BOILRD OF COMMISSIONERS OF CABARRUS COUNTY RESOLVES THAT: <br /> <br />The Board of Commissioners authorizes the County Purchasing Agent to <br />sell by private sale the following items of surplus personal property: <br /> <br />Excess Fill Dirt at the Arena and Events Center <br /> <br />2 o <br /> <br />The Purchasin9 Agent shall publish a notice summarizing this <br />resolution, and no sale may be executed pursuant to this resolution <br />until at least 10 days after the day the notice is published. <br /> <br />Adopted this 27tn day of January 2003. <br /> <br />ATTESTED BY: <br />/s/ Frankie F. The cost of the <br />move and the renovations is estimated at $30,000.00 and will be funded with <br />the appropriation made for the purchase of the Pitts School Road Elementary <br />property. <br /> <br /> <br />
