However, he stated he could not address the legal <br />issues that were raised during the meeting about the petition without further <br />review. Mr. Hartsell outlined the following options for the Board: (1) Remand <br />to Planning and Zoning Commission for further hearing and/or hearing de novo <br />or file another application; (2) Defer action until he has the opportunity to <br />look into the legal procedures and associated requirements; (3) Proceed and <br />adopt with consideration; or (4) Reject petition. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner <br />Carpenter and unanimously carried, the Board remanded Petition C02-03(R) back <br />to the Planning and Zoning Commission for further proceedings consistent with <br />the application. <br /> <br />(F-5) Consent Agreement for Craft Homes Subdivision - C02-08(S) <br /> <br /> Mr. Jonathan Marshall, Planning and Zoning Services Director, presented <br />the Consent Agreement for the Craft Homes Subdivision, Petition C02-08(S). <br />He stated the Planning and Zoning Commission had voted to approve the <br />subdivision with the condition that a Consent Agreement addressing adequacies <br />of public facilities be executed between the applicant and the Board of <br />Commissioners. <br /> <br /> There was discussion regarding the time of payment for the $500.00 per <br />lot for school facilities, specifically prior to filing of final plat or upon <br />the issuance of the Certificate of Occupancy. Mr. Marshall confirmed that <br />Craft Homes had requested that payment be made at the time a Certificate of <br />Occupancy is issued. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Chairman Freeman with <br />Commissioners Privette and Carruth, Chairman Freeman and Vice Chairman Suggs <br />voting for and Commissioner Carpenter voting against, the Board approved the <br />Consent Agreement for the Craft Homes Development between Cabarrus County and <br />Craft Homes as presented by Mr. Marshall, with the payment of $500.00 per lot <br />for school facilities at the time a Certificate of Occupancy is issued and <br />with a copy of the plat to be recorded in the Register of Deeds Office. <br /> <br /> Future cases such as this where the Planning and Zoning Commission has <br />approved the subdivision will be included on the Consent Agenda for action by <br />the Board. <br /> <br />(F-6) Cabarrus/South Rowan MPO Highway 73 ,Study <br /> <br />Mr. Mike Nunn, Executive Director of the Cabarrus/South Rowan <br />Metropolitan Planning Organization (MPO), presented the North Carolina <br />Highway 73 Corridor Study developed by the MPO to address planning issues <br />along the corridor from Concord to the Cabarrus County/Mecklenburg County <br />line. The recommendations of the Study were as follows: <br /> <br />· Cabarrus County should be encouraged to adopt the Unified Development <br /> Ordinance (UDO). Adoption by the County will facilitate the <br /> comprehensive implementation of this plan or the County can adopt this <br /> Plan as a policy for the NC 73 corridor. <br />· Develop collector streets and service roads to reduce access points on <br /> NC 73. <br />· The City of Concord, Cabarrus County, and the City of Kannapolis <br /> should adopt a unified overlay district for their jurisdictions along <br /> NC 73. <br />· Amend the Cabarrus-South Rowan MPO's Long-Range Transportation Plan <br /> and Thoroughfare Plan to make NC 73 a four-lane divided highway with a <br /> 120-foot right of way. A 1,500-foot minimum spacing distance should <br /> be applied to NC 73 for future median opening locations and <br /> intersections. <br />· The Cabarrus-South Rowan MPO shall coordinate with the Mecklenburg- <br /> Union MPO on the amended cross section for NC 73. <br />· Encourage the use of park and ride facilities and transit <br /> routes/service within the NC 73 corridor. <br /> <br />In conclusion, Mr. Nunn asked the Board to adopt the study with the key <br />element being the right of way change to 120-feet and with the Unified <br />Development Ordinance item deleted. <br /> <br /> <br />
