~arch 17, ~003 Page 74 <br /> <br /> State law reference- Application for building permits, G.S. 153A-357 <br />Sec. 14-28. Approval of plans. <br /> <br />Such applications with plans and specifications shall be referred to the <br />Senior Plans Reviewer Chief Inspector, who shall examine the same to <br />determine whether the proposed construction or alteration will comply with <br />the ordinance provisions relative thereto. The Scnicr Plans Reviewer Chief <br />Inspector shall retain one set of plans and specifications as required by the <br />North Carolina General Statutes. No permit shall be issued until after <br />approval of the plans. <br />(Ord. of 5-13-91; § 3; Ord. No. 1999-06, 6-21-99) <br /> <br />Sec. 14-29. Variations. <br /> <br />(a) <br /> <br />It shall be unlawful to vary, change, or deviate from the terms of the <br />application, the plans and specifications, or the permit, except if the <br />change or deviation is clearly permissible under the ........ ~__ <br />Cc~c International Building Code (including the North Carolina <br />amendments), it may not be made until specific written approval of the <br />proposed change or deviation has been obtained from the ~ .... ~ ...... <br />services ~ ......... Public Safety Services Department <br /> <br />(b) <br /> <br />It shall be unlawful to proceed with work on a project after a <br />building, plumbing, heating, insulation, cooling, fire sprinkler, or <br />electrical contractor has been released or dismissed from the job <br />without first obtaining a letter of release from the structure's or <br />building's owner and/or the contractor. <br />(Ord. of 5-13-91 §4; Ord. of 7-17-95; Ord. No. 1999-06, 6-21-99) <br />State law reference - Changes in work, G.S. 153.359. <br /> <br />Sec. 14-30 Additional permit restrictions. <br /> <br />(a) <br /> <br />Discontinued work; expiry. If, after a permit has been obtained and <br />the work has commenced, the work is discontinued for a period of 12 <br />months, the permit immediately expires. No work authorized by a permit <br />that has expired may thereafter be performed until a new permit has <br />been secured. <br /> <br />(b) <br /> <br />Appeals from determinations of~n .... .~...~..~ .....~ ~ .... ~-~...~..~ Public Safety <br />Services Department. Unless otherwise provided by law, any appeal from <br />an order, decision, or determination of a member of the ~ .... ~ ...... <br />sc~ices department Public Safety Services Department pertaining to the <br />-~^ ~"~ .... ~ International Building Code (including North <br />Carolina amendments) or any other state building law shall be taken to <br />the commissioner of insurance or other official specified in G.S. 143- <br />139, by filing a written notice with him and with the ~ .... ~ ...... <br />services department Public Safety Services Department within ten days <br />after the day of the order, decision, or determination. Further <br />appeals may be taken to the State Building Code Council or to the <br />courts as provided by law. <br /> <br />(c) <br /> <br />Remodeling or repair by property owner. This article shall apply to all <br />situations where a property owner desires to do remodeling or repair <br />work on his own personal residence. This article is designed to <br />protect the public and the property owner from faulty workmanship and <br />mistakes. <br /> <br />(d) <br /> <br />(e) <br /> <br />Testing of unlicensed applicant for work on personal residence. <br />Whenever any person who is not a licensed contractor applies for a <br />permit for any plumbing, electrical, heating, or cooling work on his <br />own personal residence, the applicant shall be given a test by a tester <br />designated by the '~ ..... ~ ....... ~ <br /> de~.~ ....... scr''~"-- ~ .... tmcnt Public Safety <br />Services Department. The test may be written or oral at the discretion <br />of the tester. A person may take the test more than one time. If the <br />test shows that the person is capable of performing the work for which <br />the permit is sought and shows that the applicant is knowledgeable of <br />the state and local building codes, the applicant will be considered in <br />the same manner as any other application for a building permit. <br /> <br />Article does not give warranty. Nothing in this article shall be <br />deemed a warranty either as to the ability of any particular person to <br />do a particular job or as to the safety, quality, or suitability of any <br />work which is done. Neither the issuance of a permit nor the <br />inspection and approval of any work constitute a warranty. <br /> <br /> <br />
