April 21, 2003 Page 99 <br /> <br />Proposed changes to the Personnel Ordinance follow by Article and Section. The current language, <br />the proposed change, and a brief explanation for the change are included. <br /> <br />Article III. Section 14. Education Incentive Program Consolidate Ordinance by revising <br />language and adding information from Appendix G. Deletes Appendix G and places all pro~ram <br />information in one location. <br /> <br />Section 14. Education Incentive Program <br />Although the minimum qualifications have been established for all classifications within the <br />County, certain classifications are awarded educational incentives if the employee obtains an <br />educational level higher than the minimum requirements. A maximum educational level to which the <br />incentive will apply shall be established by the County Manager for each eligible position. In <br />addition, these classifications must be recommended by the County Manager and approved by the <br />Board of County Commissioners. The classifications eligible for the educational incentive program <br />are listed in Appq~i~.? of tko Pcrscnncl ~r~inanccbelow. The educational incentive program is <br />established to pay $.75 per month or $9.00 per year for each quarter hour up to 96 quarter hours <br />of credit toward a two year degree at an accredited college or university as this credit is <br />earned. The program pays $12.00 per month for every completed unit of ten (10) semester hours of <br />credit up to 120 hours toward a four year degree at an accredited college or university as this <br />credit is earned. Section 15. Reimbursement for Tuition - New section, moved from Article VI. Section <br />29 for more appropriate placement in the Ordinance. <br /> <br />A full time employee may receive reimbursement for one (1) course at a time (including those <br />taken outside of working hours) which will better equip the employee to perform assigned duties, <br />subject to the approval of the department head and the County Manager. The county shall reimburse <br />the employee for tuition costs (up to $400), provided the employee submits a receipt of tuition <br />expenses and a notice of successful completion (passing grade or better) of the course from <br />institution accredited by the Southern Association of Colleges and Schools. <br /> <br />Article V. Section 6. Sexual Harassment Policy - Change title to Unlawful Workplace Harassment <br />Policy and replace with the policy approved at the May 5, 2002 meeting. <br /> <br />Article XI. Section 4. Effective Date - Change to reflect approved revisions. <br /> <br />Section 4. Effective Date <br />This amended version of the Cabarrus County Personnel Ordinance shall become effective as of <br />February l, 1998 and revised on October 16,2000 and Aprll 21, 2003. <br /> <br />Article XII. Appendix C, Wage and Hour Policy, Section 6. Compensatory Time - Requires BOCC <br />approval for payment of overtime in lieu of compensatory time for accrued compensatory time. The <br />Board has previously authorized twice a year pay out of compensatory time to non exempt employees <br />with at least 200 hours of vacation leave and over 50 hours of accrued compensatory time. It <br />also authorized the County Manager, at his discretion, to approve payment in the event of illness <br />or other emergency of an employee. Board authorization is requested to revise the Personnel <br />Ordinance to allow the County Manager to approve payment of overtime in lieu of accrued <br />compensatory time when determined to be in the best interest of the County. This would cover <br />existing policy and the revised Ordinance would supercede previous polices. <br /> <br />SECTION 6. COMPENSATORY TIME <br />Non-exempt employees shall receive compensatory time off, in lieu of overtime compensation, at a <br />rate of not less than one and one-half hours for each hour of employment under which the overtime <br />compensation is earned. Compensatory time off may be given only where the employee has not <br />accrued compensatory time off in excess of the prescribed limits established by the Fair Labor <br />Standards Act. (see below) <br /> <br />A department head may require the scheduled use of accrued compensatory time. <br /> <br />Employees working in any work other than a public safety, emergency response, or seasonal <br />activity may not accrue more than 240 hours of compensatory time.
