<br /> Mr. Dan Coughlin, Area Director of Piedmont Behavioral Healthcare,
<br />presented the proposal to include Davidson County as a participating member
<br />of the Piedmont Area Mental Health, Developmental Disabilities and Substance
<br />Abuse Authority. The Authority now consists of the counties of Cabarrus,
<br />Rowan, Stanly and Union. Davidson has been operating as a single county
<br />mental health program, but cannot continue to do so under new mental health
<br />legislation.

<br /> UPON MOTION of Commissioner Privette, seconded by Commissioner
<br />Carpenter and unanimously carried, the Board adopted the following
<br />Resolution.

<br /> JOINT RESOLUTION
<br /> OF THE BOARDS OF COUNTY COMMISSIONERS
<br /> OF CA~ARRUS COUNTY, DAVIDSON COUNTY, ROWAN COUNTY,
<br /> STANLY COUNTY, AND UNION COUNTY
<br />
<br /> WHEREAS, the Board of County Commissioners of Cabarrus County, the
<br />Board of County Commissioners of Stanly County, and the Board of County
<br />Commissioners of Union County by Joint Resolution dated April 1, 1974,
<br />established Piedmont Area Mental Health Program; and
<br />
<br /> WHEREAS, the Board of County Commissioners of Cabarrus County, the
<br />Board of County Commissioners of Stanly County, and the Board of County
<br />Commissioners of Union County by Joint Resolution dated March 31, 1981,
<br />modified their Joint Resolution dated April 1, 1974, by naming the entity
<br />~Piedmont Area Mental Health, Mental Retardation, and Substance Abuse
<br />Authority; and
<br />
<br /> WHEREAS, the Board of County Commissioners of Rowan County have by
<br />resolution unanimously adopted in May, 1997, requested to join Piedmont Area
<br />Mental Health, Mental Retardation and Substance Abuse Authority; and
<br />
<br /> WHEREAS, the Commission for Mental Health, Developmental Disabilities,
<br />and Substance Abuse Services has in July, 1997 designated Cabarrus, Rowan,
<br />Stanly and union Counties as a catchment area for the provision of mental
<br />health, developmental disabilities, and substance abuse services pursuant to
<br />G.S. 122C-115(c) and
<br />
<br /> WHEREAS, by Joint Resolution dated October 1, 1997, the County
<br />Commissioners of Cabarrus, Rowan, Stanly and Union Counties included Rowan
<br />County as a participating county in the area authority and renamed it
<br />Piedmont Area Mental Health, Developmental Disabilities and Substance Abuse
<br />Authority: and;
<br />
<br /> WHEREAS, by Session Law 2001-437 effective July 1, 2002, entitled "An
<br />Act to Phase In Implementation of Mental Health System Reform at the State
<br />and Local Level," the North Carolina General Assembly has amended North
<br />Carolina General Statute Chapter 122C, the Boards of Commissioners of the
<br />participating counties desire to make the joint resolution creating Piedmont
<br />Area Mental Health conform to the requirements of the newly amended law,
<br />
<br /> WHEREAS, by resolution dated January 14, 2003, the Board of
<br />Commissioners of Davidson County stated its intention ~to seek adoption of a
<br />joint resolution by and between the Boards of Commissioners of Davidson,
<br />Rowan, Cabarrus, Stanly and union Counties to the end that Davidson County,
<br />pursuant to G. S. 122C-115 (c), may become a participating county of the
<br />Multi-County Area Authority known as Piedmont Area Mental Health,
<br />Developmental Disabilities and Substance Abuse Authority doing business as
<br />Piedmont Behavioral Healthcare for the provision of Services in Davidson
<br />County."

<br /> WHEREAS, the parties to this agreement believe that it is in the best
<br />interest of the citizens of Cabarrus, Davidson, Rowan, Stanly and Union
<br />Counties that Davidson County be a participating county in Piedmont Area
<br />Mental Health, Developmental Disabilities and Substance Abuse Authority.

<br />NOW, THEREFORE, BE IT RESOLVED JOINTLY BY THE BOARDS OF COUNTY
<br />COMMISSIONERS OF CABARRUS COUNTY, DAVIDSON COUNTY, ROWAN COUNTY, STANLY
<br />COUNTY, D/TD UNION COUNTY t~at the Joint Resolution of the Boards of County
<br />Commissioners of Cabarrus, Stanly, and Union Counties dated April 1, 1974, as
<br />amended by the Joint Resolution of the Boards of County Commissioners of
<br />Cabarrus, Stanly and Union Counties dated March 31, 1981, and as further
<br />amended by the Joint Resolution of the Boards of County Commissioners of
<br />Cabarrus, Rowan, Stanly and Union Counties dated October 1, 1997, be amended
<br />and restated as follows:
