Effect on Prior Resolutions <br /> This resolution is intended to amend and restate the Joint Resolution <br />of the Boards of County Commissioners of Cabarrus, Stanly and Union Counties <br />dated April 1, 1974, as amended by the Joint Resolution of the Boards of <br />County Commissioners of Cabarrus, Stanly and Union Counties dated March 31, <br />1981, and as further amended by the Joint Resolution of the Boards of County <br />Commissioners of Cabarrus, Stanly, Rowan and Union Counties dated October 1, <br />1997. <br /> <br /> Section 2. Establishment of Piedmont Area Mental Health, Developmental <br />Disabilities, and Substance Abuse Authority <br /> There is hereby created and established pursuant to G.S. Chapter 122C- <br />115 (c) an area mental health, developmental disabilities, and substance abuse <br />authority known as Piedmont Area Mental Health, Developmental Disabilities and <br />Substance Abuse Authority (hereinafter sometimes referred to as "Piedmont <br />Area Authority") to provide mental health, developmental disabilities, and <br />substance abuse services in Cabarrus County, Davidson County, Rowan County, <br />Stanly County, and Union County. <br /> <br /> Section 3. Status and Powers and Duties of Piedmont Area Mental <br />Health, Developmental Disabilities, and Substance Abuse Authority. <br /> Piedmont Area Authority shall be a local political subdivision of the <br />State of North Carolina pursuant to G. S. 122C-116 and shall have the powers <br />and duties conferred upon it by G. S. 122C-117. <br /> <br /> Section 4. Structure of Area Board <br /> The Area Board of Piedmont Area Authority shall be composed of 20 <br />members with four from each participating county of the Area Authority with <br />Area Board members and shall be made up according to the requirements of G.S. <br />122C-118.1. <br /> <br /> Section 5. Organization of the Area Board <br /> The Area Board shall elect a Chair and a Vice-Chair and shall be <br />organized as provided in G.S. 122C-119. <br /> <br />Part 1. Nominating Committee <br />The Chairman, with the advice and consent of the Board, shall appoint in May <br />of each year a Nominating Committee consisting of three members from the <br />Board. The members of this committee shall present to the board at the June <br />meeting a slate of officers for the next year. <br /> <br />Part 2. Finance Committee <br />In accordance with N.C.G.S. 122C-119, the area board shall establish a <br />finance committee that shall meet at least six times per year to review the <br />financial strength of the area program. The finance committee shall be a <br />committee of the whole area board. The area board's meetings as finance <br />committee shall take place immediately prior to each meeting of the area <br />board and shall be distinct from its meetings as area board. <br /> <br />Part 3. Client Rights Committee <br />The Area Board shall establish and maintain a Client Rights Committee. <br /> <br />Part 4. Ad Hoc Committees <br />The Chairman, the Executive Committee or the Board may establish any Ad Hoc <br />Committees needed. <br /> <br /> Section 6. Area Director <br />Part 1. Appointment <br />The Area Board shall appoint an Area Director in accordance with G.S. 122C- <br />117(7) and 122C-121(d), subject to the approval of the participating boards <br />of county commissioners (except where the authority to approve the <br />appointment has been waived by one or more participating boards of county <br />commissioners) through a search committee of the area board which includes <br />consumer members, a county manager and one or more county commissioners. The <br />Secretary of the Department of Health and Human Services shall have the <br />option of appointing a member of the search committee. <br /> <br />Part 2. Role of the Area Director <br />The Area Director shall be the employee of the Board. The Area Director is <br />the administrative head of the Area Authority and shall: <br /> <br />(1) <br />(2) <br />(3) <br /> <br />Appoint and supervise area program staff. <br />Administer area authority services. <br />Develop the budget of the area authority for review by the area board. <br /> <br /> <br />
