The Planning and Zoning Commission unanimously approved the <br />subdivision on June 19, 2003, with the condition that the Board of <br />Commissioners accept the Consent Agreement. The Planning Board's approval <br />included design approval for the 40-lot subdivision on 10.9 acres with a <br />proposed density of 3.67 units per acre. The developer has offered $500.00 <br />per lot for adequate public facilities. <br /> <br /> There was discussion regarding the proposed subdivision, including <br />design approval by the Planning and Zoning Commission, the proposed density <br />and the developer's offer to contribute $500.00 per lot toward school <br />adequacy. Commissioner Carruth cited concerns about the growth in the county, <br />the lack of funding to build new schools and the continued approval of new <br />subdivisions. Commissioner Carpenter objected to the proposed density and the <br />congestion that currently exists in that area of the county. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Vice Chairman Suggs <br />with Commissioner Privette, Vice Chairman Suggs and Chairman Freeman voting <br />for and Commissioners Carruth and Carpenter voting against, the Board <br />accepted the Consent Agreement with Shiloh Ridge Development L.L.C., for the <br />Shiloh Village Subdivision and authorized the County Manager to execute the <br />Consent Agreement on behalf of Cabarrus County. The Consent Agreement <br />included the payment of $500.00 per single family lot to advance shool <br />adequacy with payment to be made at the issuance of building permitting. <br /> <br />(F-6) Consent ~re~ent - Magnolia Sprin~s Subdivision, Saturd~ Inves~ents <br />L.L.C. <br /> <br /> Mr. Rodger Lentz, Planning Manager, presented the proposed Consent <br />Agreement with Saturday Investments, L.L.C., for the Magnolia Springs <br />Subdivision to be located on the north side of Rocky River Road between <br />Hickory Ridge Road and Robinson Church Road. The Planning and Zoning <br />Commission unanimously approved the subdivision on June 19, 2003, with the <br />condition that the Board of Commissioners accept the Consent Agreement. The <br />Planning Board's approval included design approval for the 200-lot <br />subdivision on 79.45 acres with a proposed density of 2.6 units per acre. <br />The developer has offered $500.00 per lot for adequate public facilities. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Vice Chairman Suggs <br />with Commissioners Privette and Carpenter, Vice Chairman Suggs and Chairman <br />Freeman voting for and Commissioner Carruth voting against, the Board <br />accepted the Consent Agreement with Saturday Investments, L.L.C., for the <br />Magnolia Springs Subdivision and authorized the County Manager to execute the <br />Agreement on behalf of Cabarrus County. The Consent Agreement included the <br />payment of $500.00 per single family lot to advance school adequacy with <br />payment to be made at the issuance of building permitting. <br /> <br /> Mr. Robert Morrison, property owner, again complained of the control <br />that the City of Concord has on water service in Cabarrus County and the <br />inability to get water service to his property. <br /> <br />(F-7) Consent Agreement - Hammermill Subdivision, L & R Investments L.L.C. <br /> <br /> Vice Chairman Suggs asked to be recused from consideration of the <br />Hammermill Subdivision due to his involvement in the project. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board voted to recuse Vice Chairman Suggs from <br />consideration of the Hammermill Subdivision. <br /> <br /> Mr. Rodger Lentz, Planning Manager, presented the proposed Consent <br />Agreement with L & R Investments, L.L.C., for Hammermill Subdivision to be <br />located on the east side of Roberta Road just north of Rocky River. The <br />development is split between the Town of Harrisburg and Cabarrus County's <br />planning jurisdiction with 53 proposed lots in Cabarrus County and 95 <br />proposed lots in the Town's jurisdiction. The Planning and Zoning Commission <br />unanimously approved that part of the subdivision located in the County's <br />jurisdiction on June 19, 2003, with the condition that the Board of <br />Commissioners accept the Consent Agreement. The approval included design <br />approval for the 53-1ot subdivision on 14.94 acres with a proposed density of <br />3.55 units per acre. The developer has offered $500.00 per lot for adequate <br />public facilities. <br /> <br /> Commissioner Privette made a motion, seconded by Chairman Freeman, to <br />accept the Consent Agreement with L & R Investments, L.L.C., for the <br />Hammermill Subdivision and to authorize the County Manager to execute the <br /> <br /> <br />
