October 20, 2003 Page 274 <br /> <br /> Commissioner Carruth commented on the earlier discussion regarding the <br />proposed increase in the hotel occupancy tax and the continued delay in making <br />a decision concerning the issue. <br /> <br />(K) CLOSED SESSION <br /> <br /> UPON MOTION of Chairman Freeman, seconded by Vice Chairman Suggs and <br />unanimously carried, the Board moved to go into Closed Session in Conference Room <br />A at the Governmental Center for the following purposes: (1) To discuss matters <br />relating to the location or expansion of industries or other businesses in <br />Cabarrus County as authorized by North Carolina General Statute (NCGS) 143- <br />318.11(a) (4); (2) To consult with the County Attorney to preserve the attorney- <br />client privilege and to discuss pending or threatened litigation as authorized <br />by NCGS 143-318.11(a) (3); and (3) To discuss personnel matters as authorized by <br />NCGS 143-318.11(a) (6) . <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Carruth and <br />unanimously carried, the Board moved to come out of the Closed Session. <br /> <br />Economic Development Issues <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth and <br />unanimously carried, the Board authorized,-subject to NCGS 158-7.1, the execution <br />of contract and sale for Centdev Properties LLC for 2.5 acres on Union'Cemetery <br />Road in the amount of $500,000.00; for FFC Limited Partnership for one acre at <br />the corner of Union Cemetery Road and Cabarrus Avenue in the amount of <br />$432,000.00; and for Mike Everett for two acres on Concord Parkway in the amount <br />of-$320,000.00, subject to appraisal. Each conveyance shall be subject to a <br />public hearing prior to the closing, if any. <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette with <br />Commissioners Carruth and Privette and Chairman Freeman and Vice Chairman Suggs <br />voting for and Commissioner Carpenter voting against, the Board authorized the <br />County Manager and consultant (Cornerstone) to create a new record plat for the <br />former Fairgrounds property; to request rezoning of the former School <br />Administrative property; and to pursue the subdivision of the former School <br />Administrative property, subject to appraisal of that property. Further, the <br />Board authorized the management fee to Cornerstone relative to the record plat <br />for the former Fairgrounds property and the rezoning of the former School <br />Administrative property. <br /> <br /> Closed Session - Personnel Matters and Pendin~ or Threatened Litigation <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette and <br /> unanimously carried, the Board moved to go into Closed Session to discuss <br /> personnel matters and to consult with the County Attorney regarding pending or <br /> threatened litigation as authorized by NCGS 143-318.11(a) (6) (3). <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carpenter <br /> and unanimously carried, the Board moved to come out of Closed Session. <br /> Commissioner Carruth asked to be recused from discussion regarding the <br /> Systel matter due to business involvement with the company through his employer. <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carpenter <br /> and unanimously carried, the Board voted to recuse Commissioner Carruth from <br /> discussion on the Systel matter. <br /> <br /> Commissioner Carruth left the Conference Room. <br /> <br /> ~ON MOTION of Commissioner Privette, seconded by Commissioner Carpenter <br /> with Commissioners Privette and Carpenter and Chairman Freeman and Vice Chairman <br /> Suggs voting for, the Board moved to go into Closed Session to consult with the <br /> County Attorney regarding pending litigation and to discuss personnel matters as <br /> authorized by NCGS 143-318.11(a) (3) (6). <br /> <br /> Commissioner Carruth returned to the Closed Session at 11:45 p.m. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Carruth and <br /> unanimously carried, the Board moved to come out of the Closed Session. <br /> <br /> No action was reported from the Closed Session. <br /> <br />Lease of the First Union Buildin~ <br /> <br /> Commissioner Carpenter asked to be recused from discussion regarding the <br />lease for the First Union Building due to her employment with Wachovia Bank <br />(formerly First Union). <br /> <br /> <br />
