November 17, 2003 Page 294 <br /> <br />with the County Attorney to preserve the attorney-client privilege and to discuss <br />pending or threatened litigation as authorized by North Carolina General Statute <br />143-318.11(a) (3) · Further, the Board invited Mr. James Scarbrough, Attorney, to <br />join the Board for that portion of the Closed Session relative to pending or <br />threatened litigation. <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carpenter <br />and unanimously carried, the Board moved to come out of the Closed Session and <br />return to open session. <br /> <br />Assi~D-~snt of Water and Sewsr Connection Rights <br /> UPON MOTION of Commissioner Privette, seconded by Vice Chairman Suggs and <br /> unanimously carried, the Board adopted the following Motion (Resolution): <br /> Resolution No. 2003-35 <br /> <br /> MOTION TO ASSIGN WATER AND SEWER CONNECTION RIGHTS <br /> <br />Whereas, on August 15, 1988, Cabarrus County entered into an <br />agreement with the city of Concord entitled "Reciprocal Agreement <br />for Water and Sewer Connections and Related Matters"; and <br />Whereas, pursuant to the agreement the County has the absolute right <br />and privilege to connect to Concord's Regional water and sewer <br />system; and <br />Several owners of land located outside the city limits of Concord <br />desire to connect to Concord's Regional water and sewer system; and <br />Whereas, the County desires to assign to those landowners a right to <br />connect; <br /> Therefore, the county attorney is directed to prepare standard <br /> assignments wherein the owners and developers and their successors <br /> and assigns of the following parcels of land will be assigned a <br /> right to connect to Concord's water and sewer system in order to <br /> service the developments now proposed for the following tax parcels <br /> and appearing on preliminary plats already approved by the County. <br /> Further, no fee will be charged for these assignments and the <br /> Chairman is delegated authority to execute the assignments on behalf <br /> of the County. No warranties shall be provided in the assignment; <br /> and the County shall continue to retain all connection rights under <br /> the Reciprocal Agreement as fully as if no assignment had been made. <br /> Tax parcel 5538-38-8012 (Brandon Ridge by Craft Homes) <br /> Tax parcel 5538-47-6873 (Brandon Ridge by Craft Homes) <br /> Tax Parcel 5539-52-6448 (Park Place by Craft Homes) <br /> Tax Parcel 5539-62-4526 (Park Place by Craft Homes) <br /> Tax parcel 5539-31-0300 (Morrison Creek Subdivision by Morrison <br /> Creek LLC) <br /> Tax parcel 5539-21-0002 (Morrison Creek Subdivision by Morrison <br /> Creek LLC) <br /> <br />WATER AND SEWER DISTRICT MEETING <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Privette <br />and unanimously carried, the Board recessed the meeting of the Board of <br />Commissioners until the conclusion of the Water and Sewer District meeting. <br /> Chairman Freeman reconvened the meeting of the Board of Commissioners at <br />9:35 p.m. <br /> <br />CLOSED SESSION <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to go into Closed Session to discuss <br />personnel matters (NCGS 143-318.11(a) (6), to discuss matters relating to the <br />location or expansion of industries or other businesses in Cabarrus County (NCGS <br />143-318.11(a) (4) and to consult with the County Attorney to preserve the <br />Attorney-Client privilege and to discuss pending-or threatened litigation [(NCGS <br />143-318.11(a) (3)] . <br /> <br /> <br />
