Bonds <br />Clerk to the Board <br /> <br />(G-13) Consent Agreement between Cabarrus County and Yates Properties, LLC for <br />the Jacob's Ridge Subdivision <br /> <br /> Yates Properties, LLC, the developer of the Jacob's Ridge Subdivision, <br />wishes to enter into a Consent Agreement with the Board and has agreed (letter <br />dated November 18, 2003) to donate $1,008.00 per lot to advance adequacy of <br />public schools. The subdivision is located off Stirewalt Road and will include <br />27 lots on 64.83 acres. The subdivision meets all other regulations and was <br />approved by the Planning and Zoning Commission subject to the developer entering <br />into a consent agreement to meet the Adequate Public Facilities Ordinance <br />requirements for school facilities. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth and <br />unanimously carried, the Board approved the Consent Agreement with Yates <br />Properties, LLC for the Jacob's Ridge Subdivision and authorized the County <br />Manager to execute the Agreement on behalf of Cabarrus County. The Consent <br />Agreement included the payment of $1,008.00 per single family lot to advance <br />school adequacy with the payment to be made at the issuance of the building <br />permitting. <br /> <br />(G-14) Resolution Authorizing Submission of Grant Application to the N. C. <br />Department of Transportation for Public and Human Service Transportation Service <br /> <br /> The North Carolina Department of Transportation Public Transportation <br />Division 5311 Grant Award application is reviewed annually. The Grant is for the <br />administrative and capital expense of the Cabarrus Community Transportation <br />System (CCTS). The administrative grant amount applied for is $145,000.00 and <br />the capital grant amount applied for is $245,000.00, including advanced <br />technology and personnel development funding. The required County match for the <br />administrative funding 15%) is $21,750.00 and capital funding (10%) is <br />$24,500.00. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth and <br />unanimously carried, the Board adopted the following Resolution authorizing the <br />County Manager to complete the 5311 Grant application for Federal and State funds <br />and the expenditure of required matching funds when the Grant is approved. <br /> <br /> Resolution No. 2003-37 <br /> COMMUNITY TRANSPORTATION PROGRAM RESOLUTION <br /> RESOLUTION <br /> <br />Applicant Seeking Permission to Apply for Community Transportation Proqram <br />Funding, Enter Into Agreement with the North Carolina Department of <br />Transportation and to Provide the Necessary Assurances <br /> <br />A motion was made by Commissioner Privette and seconded by Commissioner Carruth <br />for the adoption of the following resolution, and upon being put to a vote was <br />duly adopted. <br /> <br />WHEREAS, Article 2B of Chapter 136 of the North Carolina General <br />Statutes and the Governor of North Carolina have designated the <br />North Carolina Department of Transportation (NCDOT) as the agency <br />responsible for administering federal and state public <br />transportation funds; and <br /> <br />WHEREAS, the North Carolina Department of Transportation will apply <br />for a grant from the US Department of Transportation, Federal <br />Transit Administration, and receives funds from the North Carolina <br />General Assembly to provide assistance for rural public <br />transportation projects; and <br /> <br />WHEREAS, the purpose of these transportation funds is to provide <br />grant monies to local agencies for the provision of rural public <br />transportation services consistent with the policy requirements for <br />planning, community and agency involvement, service design, service <br />alternatives, training and conference participation, reporting and <br />other requirements (drug and alcohol testing policy and program, <br />disadvantaged business enterprise program, and fully allocated costs <br />analysis); <br /> <br />WHEREAS, Cabarrus County hereby assures and certifies that it will <br />comply with the federal and State Statutes, regulations, executive <br />orders, Section 5333(b) Warranty, and all administrative <br /> <br /> <br />
