October 21, 2002 Page 467 <br /> <br /> Mr. Hartsell explained the proposed adequate public facilities <br />ordinance is more detailed than the current ordinance and would be more <br />instructive to the development community and staff in making determinations <br />regarding the adequacy of such facilities as schools, roads and water and <br />sewer. However, he pointed out the current ordinance had been approved by a <br />court of appeals. <br /> <br /> At 9:58 p.m., Chairman Freeman opened the public hearing on the <br />proposed Amendment (Adequate Public Facility Standards) to the Zoning <br />Ordinance. The Public Hearing Notice had been published in THE INDEPENDENT <br />TRIBUNE on October 11 and October 20, 2002. <br /> <br /> Mr. Ric Starnes, former member of the Cabarrus County Planning and <br />Zoning Commission, spoke in support of the proposed adequate public <br />facilities standards. He stated the standards are the only tools that are <br />available for controlling growth in the county. <br /> <br /> Mr. James Scarbrough stated to his knowledge the building industry has <br />not had the opportunity to review the proposed adequate public facilities <br />ordinance and provide input regarding those standards. <br /> <br /> Mr. Lentz advised that the proposed standards are the same as had been <br />drafted for the Unified Development Ordinance (UDO). He stated the building <br />industry had been very involved in the drafting of that article of the UDO. <br /> <br /> There was no one else present to address the Board, and Chairman <br />Freeman closed the public hearing at 10:05 p.m. <br /> <br /> UPON MOTION of Commissioner Suggs, seconded by Vice Chairman Carruth <br />and unanimously carried, the Board deferred consideration of the proposed <br />adequate public facility standards until a future retreat of the Board. <br /> <br />(F-3) Proposed Non-EmergencY Transport Service Franchise Agreement with Mid- <br />State 'Transport - Public Hearing - 6530 p.m. (or as soon thereafter a~ <br />persons may be heard) <br /> <br /> Mr. Mike Downs, Public Safety Services Director, reviewed recent <br />activities associated with non-emergency transport services in the County. <br />The County received notice in August that Harrisburg Fire and Rescue would be <br />terminating service on September 30tn due to the lack of revenue. In order to <br />continue to provide service, Harrisburg Fire had requested that the County <br />respond to certain conditions, including a $90.00 subsidy for each call. At <br />the September 16tn meeting, the Board had authorized the County Manager and <br />County Attorney to move forward with a contract with Mid-State Transport to <br />provide non-emergency transports on a per call basis with the County to <br />provide billing and administration. Staff had proceeded with the development <br />of that contract and with the requirements for granting a non-emergency <br />ambulance franchise to Mid-State. He asked the Board to conduct the required <br />public hearing at this time and consider the proposed Franchise Agreement <br />along with an interim agreement with Mid-State. Also, Mr. Downs reported <br />that Harrisburg Fire and Rescue submitted a proposal on October 18 to enter <br />into a contract similar to the one proposed with Mid-State for non-emergency <br />transports. <br /> <br /> Mr. Clifton explained the County had pursued other alternatives after <br />receiving the notice that Harrisburg Fire and Rescue planned to terminate <br />service on September 30. He stated that the County EMS has been providing <br />the non-emergency transports since October 1 and requested that the County <br />enter into the interim agreement with Mid-State Transport until the franchise <br />procedures can be completed. <br /> <br /> At 10:12 p.m., Chairman Freeman opened the public hearing on the <br />application from Mid-State Transport for a franchise to operate a non- <br />emergency ambulance service in Cabarrus County. The Public Hearing Notice <br />was published in THE CHARLOTTE OBSERVER (Cabarrus Neighbors) on October 6 and <br />13, 2002. The documents and exhibits associated with the franchise <br />application were included as a part of the Agenda. <br /> <br /> Ms. Carolyn Carpenter spoke in support of a contract with Harrisburg <br />Fire and Rescue to provide non-emergency transports. She cited their <br />experience in emergency care, knowledge of the area, ability to provide EMT- <br />Intermediate level of service and proposed cost of $103.00 per call as <br />compared to $105.00 per call by Mid-State. In conclusion, she presented a <br />letter from Cindy Watson from Eden Gardens commending Harrisburg Fire and <br />Rescue on the service they provide to that facility. <br /> <br /> <br />
