December 16, 2002 Page 508 <br /> <br /> WHEREAS, some uncertainty exists as to the precise location of the <br />boundary, at certain places, between Mecklenburg and Cabarrus Counties; and <br /> <br /> WHEREAS, the Cabarrus County Board of Commissioners, pursuant to <br />N.C.G.S. 153A-18, appointed Jonathan Marshall to be a special commissioner to <br />supervise the surveying, marking and mapping of the boundary between <br />Mecklenburg and Cabarrus Counties; and <br /> <br /> WHEREAS, Mecklenburg County also appointed a special commissioner to <br />supervise the surveying, marking and mapping; and <br /> <br /> WHEREAS, the special commissioner for Mecklenburg County and the <br />special commissioner for Cabarrus County have now agreed upon a survey <br />showing an acceptable boundary between the two counties, a copy of a map <br />showing the surveyed boundary being attached as Exhibit A and incorporated <br />herein by reference ("Map"); and <br /> <br /> WHEREAS, the Board of County Commissioners of Cabarrus County has <br />agreed that the boundary between Mecklenburg County and Cabarrus County shall <br />be as shown on the Map; now, therefore, be it <br /> <br /> RESOLVED that the Cabarrus County Board of Commissioners does hereby <br />ratify the survey of the boundary between Mecklenburg County and Cabarrus <br />County as shown on the Map attached as Exhibit A; and be it further <br /> <br /> RESOLVED that once the Map has been ratified by the Board of <br />Commissioners of Cabarrus County, the date of each resolution of ratification <br />and the page in the minutes of each Board of Commissioners where the <br />resolution shall be found shall be placed on the Map before recordation; and <br />be it further <br /> <br /> RESOLVED that once the Map has been ratified by the Board of County <br />Commissioners of Mecklenburg County, that Jonathan Marshall, special <br />commissioner under G.S. 153A-18, shall cause the Map showing the newly agreed <br />upon boundary to be recorded in the Office of the Register of Deeds of <br />Cabarrus County in the manner required by law for the recordation of maps or <br />plats and to work with the special commissioner for Mecklenburg County to <br />cause a copy of the Map to be recorded in the Office of the Register of Deeds <br />of Mecklenburg County; and be it further <br /> <br /> RESOLVED that Jonathan Marshall is directed to cause a copy of the Map <br />to be recorded in the Secretary of State's Office; and be it further <br /> <br /> RESOLVED that the new boundary between Mecklenburg County and Cabarrus <br />County is to become effective January 1, 2003; and be it further <br /> <br /> RESOLVED that Jonathan Marshall is directed to report back to the Board <br />of County Commissioners once all of said actions have been taken. <br /> <br />Adopted the 16tn day of December, 2002. <br /> <br />/s/ Robert M. Grid Coordinates of N: 162,883.352m E: 468,455.290m and <br />being the POINT OF BEGINNING. <br /> <br />Thence from said POINT OF BEGINNING N 56°46'13" W a grid distance of <br />8392.185m to a computed point having metric NAD 83 - N.C.
