December 16, 2002 Page 506 <br /> <br /> WHEREAS, the intent of the NCRC is to provide a uniform statewide, <br />harmonious system of rehabilitation regulations applicable to existing <br />buildings within the state; and <br /> <br /> WHEREAS, the NCRC is only available for use in those jurisdictions, <br />including Cabarrus County, which have been granted local plan review <br />authority; and <br /> <br /> WHEREAS, the enabling legislation adopting the NCRC requires qualifying <br />local jurisdictions to adopt the NCRC by ordinance; and <br /> <br /> WHEREAS, it would be in the best interest of the citizens of Cabarrus <br />County to adopt the NCRC as an alternative means of rehabilitating existing <br />buildings. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF <br />CABARRUS COUNTY THAT THE CODE OF ORDINANCES, CAB~LRRUS COUNTY, NORTH CAROLINA, <br />IS HEREBY AMENDED BY ADDING A SECTION, TO BE NUMBERED 14-33, WHICH SECTION <br />READS AS FOLLOWS: <br /> <br />Section 14-33 <br /> <br />North Carolina Rehabilitation Code Adopted <br /> <br />(a) <br /> <br />The North Carolina Rehabilitation Code as enacted by the North Carolina <br />General Assembly and as modified by supplements covering amendments <br />thereto, is hereby adopted by reference as fully as though set forth <br />herein as a supplemental building code for Cabarrus County to the <br />extent such code is applicable. <br /> <br />(b) <br /> <br />Ail ordinances or portions of ordinances in conflict herewith are <br />hereby repealed. <br /> <br />(c) <br /> <br />Should any provision of this ordinance be declared invalid or <br />unconstitutional by any court of competent jurisdiction, such <br />declaration shall not affect the validity of the ordinance as a whole <br />or any part thereof, which is not specifically declared to be invalid <br />or unconstitutional. <br /> <br />(d) <br /> <br />This ordinance shall take effect and be in force from and after the <br />date of its adoption. <br /> <br />Adopted this the 16tn day of December 2002. <br /> <br /> /s/ Robert M. Bonds, Clerk to the Board <br /> <br />(F-4) Grading and Wetlands Mitigation Proposal from J & B Development <br /> <br /> Mr. Jonathan Marshall, Planning and Zoning Services Director, presented <br />the proposal for the County and Mr. Bob Burkett of J & B Development to work <br />together on the grading and wetlands mitigation for a new elementary school <br />site adjacent to the Harris Road Middle School. Mr. Burkett had donated the <br />property for the two school sites in conjunction with the approval of the <br />Moss Creek subdivision that he is developing on property adjacent to the <br />school sites. <br /> <br /> Mr. Burkett stated he wished to assist County staff in moving the <br />process forward to obtain required permits and to determine any wetlands <br />mitigation that will be required on the school property. <br /> <br /> UPON MOTION of Vice Chairman Suggs, seconded by Commissioner Privette <br />and unanimously carried, the Board agreed for County staff to work with Mr. <br />Bob Burkett on the grading and wetland mitigation at the Harris Road school <br />sites. Further, the Board expressed appreciation to Mr. Burkett for assisting <br />with this work. <br /> <br />(F-5) Water and Sewer Authority Resolution Addressing Storm Water Management <br />Program <br /> <br /> Mr. Jonathan Marshall, Planning and Zoning Services Director, <br />introduced the proposal by the Water and Sewer Authority (WSACC) Board of <br />Directors for that entity to become the regional storm water management <br />program provider. <br /> <br /> <br />
