December 16, 2002 Page 506 WHEREAS, the intent of the NCRC is to provide a uniform statewide, harmonious system of rehabilitation regulations applicable to existing buildings within the state; and WHEREAS, the NCRC is only available for use in those jurisdictions, including Cabarrus County, which have been granted local plan review authority; and WHEREAS, the enabling legislation adopting the NCRC requires qualifying local jurisdictions to adopt the NCRC by ordinance; and WHEREAS, it would be in the best interest of the citizens of Cabarrus County to adopt the NCRC as an alternative means of rehabilitating existing buildings. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF CABARRUS COUNTY THAT THE CODE OF ORDINANCES, CAB~LRRUS COUNTY, NORTH CAROLINA, IS HEREBY AMENDED BY ADDING A SECTION, TO BE NUMBERED 14-33, WHICH SECTION READS AS FOLLOWS: Section 14-33 North Carolina Rehabilitation Code Adopted (a) The North Carolina Rehabilitation Code as enacted by the North Carolina General Assembly and as modified by supplements covering amendments thereto, is hereby adopted by reference as fully as though set forth herein as a supplemental building code for Cabarrus County to the extent such code is applicable. (b) Ail ordinances or portions of ordinances in conflict herewith are hereby repealed. (c) Should any provision of this ordinance be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration shall not affect the validity of the ordinance as a whole or any part thereof, which is not specifically declared to be invalid or unconstitutional. Bonds, Clerk to the Board (F-4) Grading and Wetlands Mitigation Proposal from J & B Development Mr. Jonathan Marshall, Planning and Zoning Services Director, presented the proposal for the County and Mr. Bob Burkett of J & B Development to work together on the grading and wetlands mitigation for a new elementary school site adjacent to the Harris Road Middle School. Mr. Burkett had donated the property for the two school sites in conjunction with the approval of the Moss Creek subdivision that he is developing on property adjacent to the school sites. Mr. Burkett stated he wished to assist County staff in moving the process forward to obtain required permits and to determine any wetlands mitigation that will be required on the school property. UPON MOTION of Vice Chairman Suggs, seconded by Commissioner Privette and unanimously carried, the Board agreed for County staff to work with Mr. Bob Burkett on the grading and wetland mitigation at the Harris Road school sites. Further, the Board expressed appreciation to Mr. Burkett for assisting with this work. (F-5) Water and Sewer Authority Resolution Addressing Storm Water Management Program Mr. Jonathan Marshall, Planning and Zoning Services Director, introduced the proposal by the Water and Sewer Authority (WSACC) Board of Directors for that entity to become the regional storm water management program provider.
