186 <br /> <br />natural wildlife inhabiting the area and the citizens of <br />Cabarrus County, North Carolina. The real estate may only <br />be used for the purposes stated herein and shall revert to <br />the heirs of the Grantor, if the required purpose is not <br />observed and continued. <br />The remaining assets of this Trust shall be distributed to <br />Cabarrus County, North Carolina, for the limited purpose of <br />developing the real estate distributed in Item c. as a <br />public park. Fencing, driveways, parking areas, fellowship <br />facilities, hiking trails, pond construction and other <br />similar uses shall be permitted. However, it is the <br />Grantor's intention that the park land be shared with <br />wildlife and that no assets of the Trust be used for <br />purposes such as the construction of ball fields, race <br />tracks or other uses not friendly to wildlife. <br /> <br /> 3. WHEREAS, on June 4, 1996, Elma C. Lomax died in Cabarrus County, <br />North Carolina. <br /> 4. WHEREAS, Fletcher L. Hartsell, Jr. is the Executor of the Estate <br />of Elma C. Lomax, Deceased (96 E 386) and is Successor Trustee of the Elma C. <br />Lomax Living Trust Agreement. <br /> 5. WHEREAS, the following described real property is presently part <br />of the trust corpus and is subject to the dispositive provisions of the <br />trust: <br /> Approximately 33 acres of essentially unimproved real estate <br />located at 3332 Atando Road, Concord, North Carolina (Pin % 5549-22-1579) <br /> 6. WHEREAS, the following described personal property is presently <br />part of the trust corpus and is subject to the dispositive provisions of the <br />trust: <br /> Approximately $22,000.00 in the trust account of Hartsell, <br />Hartsell & White, P.A. <br /> 7. WHEREAS, Cabarrus County is in need of additional land for public <br />parks and is in need of land that can reasonably be preserved in its natural <br />state. <br /> 8. WHEREAS, for the foregoing reasons the Cabarrus County Board of <br />Commissioners believes it is in the best interests of the citizens and <br />residents of Cabarrus County that the Board of Coramissioners accept the gift <br />of real and personal property from the Elma C. Lomax Living Trust Agreement. <br /> <br /> BE IT RESOLVED, by affirmative vote of the Board of Commissioners on <br />this date, that the gift of the real and personal property described above <br />from the Elma C. FENNEL <br />CHAIRMAN <br />CABARRUS COUNTY BOARD OF COMMISSIGNERS <br /> <br />Certification of the Revised Cabarrus County Work First Block Grant Plan for <br />FY 2001-03 <br /> <br /> The Board received from Mr. Jim Cook, Social Services Director, the <br />recommended revisions to the Work First Block Grant Plan for FY 2001-03 as <br />requested by the Division of Social Services. The changes are to bring the <br />County's Plan into compliance following approval of the Work over Welfare <br />legislation for Cabarrus County. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Vice Chairman Carruth and <br />unanimously carried, the Board approved the revised Work First Block Grant <br />Plan for FY 2001-03 as submitted by Mr. Jim Cook, Social Services Director, <br />and authorized Chairman Fennel to sign the updated Certification form for the <br />Plan. The revisions included the following: (1) Page 9, VI.,4.a. change <br />"adequate" notice to "timely" notice; (2) Page 16, VII.,D., delete "through <br />waivers"; (3) Page 18, VIII., B.5. delete permanent disqualification <br />statement; (4) Page 19, Emergency Assistance, definition; (5) Page 20, Add <br />statement under the 200% of poverty level provisions, can serve former <br />recipients with signed application; and (6) Attach Domestic Violence <br />Memorandum of Understanding with Crisis Victims Assistance Network {CYAN). <br /> <br /> <br />
