187 <br /> <br />Proposed Contract with the Poplar Tent Volunteer Fire Department (To O~erate <br />Through Dgcember 31r 2001) <br /> <br /> The Board received the proposed contract with the Poplar Tent Volunteer <br />Fire Department as submitted by Mr. Mike Downs, Development Services <br />Director. The contract will allow the fire department to operate until <br />December 31, 2001 and to organize their dissolution during that time. There <br />will be no financial commitment from the County. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Vice Chairman Carruth and <br />unanimously carried, the Board approved the following contract between <br />Cabarrus County and the Poplar Tent Volunteer Fire Department and authorized <br />the County Manager to sign the contract on behalf of Cabarrus County. <br /> <br />CONTRACT TO PROVIDE FIRE PROTECTION SERVICE <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />This contract made and entered into the 17th day of September, 2001, by and <br />between the Poplar Tent Volunteer Fire Department, Inc., a nonprofit <br />corporation, and the County of Cabarrus. <br /> WITNESSETH: <br />That for and consideration of the mutual covenants hereinafter contained, and <br />pursuant to authority granted by G.S. 69-25.5, G.S. 69-25.6, and G.S. 153A- <br />233, the Poplar Tent Volunteer Fire Department and the County of Cabarrus do <br />hereby covenant and agree as follows: <br /> 1. The Poplar Tent Volunteer Fire Department agrees to furnish and <br /> provide continuing fire protection service to all property lying <br /> within the established Poplar Tent Fire Protection District of 1986, <br /> by dispatching upon call any or all of its equipment and adequate <br /> personnel to operate same. <br /> 2. The Poplar Tent Volunteer Fire Department agrees to operate within <br /> the guidelines set forth in the Cabarrus County Fire Protection <br /> Resolution. <br /> 3. That due to annexation of the City of Concord and City of <br /> Kannapolis, the Poplar Tent Fire Protection District was consumed by <br /> these annexation, therefore is no remaining Tax District with the <br /> established boundaries of 1986. <br /> 4. This contract is established for a time period for the Poplar Tent <br /> Volunteer Fire Department to organize a Dissolution of the <br /> corporation. This Contract will terminate at midnight December 31, <br /> 2001. <br />In witness whereof the Poplar Tent Volunteer Fire Department, Inc. has caused <br />these presents to be signed by its President and attested by its Chief, and <br />the County of Cabarrus has caused these presents to be signed by its County <br />Manager and attested by the Clerk of its Board of Commissioners. <br /> This the 17th day of September, 2001. <br /> <br />POPLAR TENT VOLUNTEER <br />FIRE DEPARTMENT, INC. <br /> <br />Attest: <br /> <br />Chief <br /> <br />Attest: /s/ Frankie F.
