If the money is not <br />needed for those ·schools, the funds will be used to repair/replace the <br />bleachers at Central Cabarrus High School. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette and <br />unanimously carried, the Board waived the right of first refusal and approved <br />the sale of the property ($500.00 - Parcel Number 128; $75,200.00 - Parcel <br />Numbers 104 and 114) located in front of Central Cabarrus High School by the <br />Cabarrus County Board of Education to the North Carolina Department of <br />Transportation for the widening of Highway 49, with the understanding that <br />the first priority for the use of the sale proceeds will be the completion of <br />the three new schools currently under construction. <br /> <br />NEW BUSINESS <br /> <br />Highland Creek Preliminary Plat Application - Case C01-05(S) <br /> <br /> Mr. Jonathan Marshall, Planning Services Director, presented C01-05(S), <br />the preliminary plat approval (revision of 1998 approval) for the Highland <br />Creek Subdivision. The applicant, Rhein Interests of Charlote, LLC, plans to <br />add another 127 lots to the 1,134 lots already approved in the subdivision. A <br />Consent Agreement is in place for the first 1,134 lots and $400,000.00 has <br />been paid to advance school capacity. The proposed density for the 1,261-1ot <br />subdivision is 3.09 units per acre on 407.618 acres. Water and sewer service <br />will be furnished by Charlotte Mecklenburg Utilities and then turned over to <br />the City of Concord when the water supply issues are resolved. To address <br />adequate public facility requirements for the additional lots, Rhein <br />Interests has agreed to participate in the realignment of Christenbury Road <br />and extension of Concord Mills Boulevard at a cost up to $250,000.00 and will <br />assume responsibility for the design, permitting and construction of the road <br />project (letter dated October 26, 2001 from James M. Medall, Vice President <br />of Rhein Interests). Cabarrus County and the North Carolina Department of <br />Transportation Will also participate financially in the road project along <br />with the Christenbury family who will donate the right-of-way for the road <br />realignment. The Planning and Zoning Commission voted 7-2 to approve the <br />technical design of Highland Creek and voted 9-0 to deny the subdivision (127 <br />lots) based on adequate public facilities requirements. <br /> <br /> There was lengthy discussion regarding the subdivision approval process <br />and the adequate public facilities requirements. The Board addressed the <br />following issues: (1) the number of approved lots (10,000+) in the county and <br />the uncertainty as to when those lots will be developed; (2) the method of <br />projecting future school population; (3) consideration by the Planning and <br />Zoning Commission of approved lots, school capacity and expected enrollment <br />during the subdivision approval process; and (4) how to determine when new <br />schools should be built. In addition, the Board briefly discussed the <br />developer's offer to participate in the Christenbury Road project that will <br />improve the safety situation in that area of the county. <br /> <br /> <br />
