233 <br /> <br /> Mr. James Medall of Rhein Interests estimated the value of homes in <br />Highland Creek at $165,000.00 per lot with the total tax value of the <br />subdivision exceeding $2 million if built out today. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Chairman Fennel and <br />unanimously carried' the Board approved Petition C01-05(S) for the additional <br />127 lots in the Highland Creek Subdivision with any changes or conditions <br />that the North Carolina Department of Transportation may require on the <br />proposed rights of ways and that the developer enters into a Consent <br />Agreement with the County to participate in the realignment of Christenbury <br />Road at a cost up to $250,000.00 as outlined in the letter dated October 26, <br />2001 by Mr. James M. Medall, Vice President of Rhein Interests. The Board <br />authorized the County Manager to execute the Consent Agreement on behalf of <br />Cabarrus County. <br /> <br /> Chairman Fennel expressed appreciation to Rhein Interests for its offer <br />to participate in the realignment of Christenbury Road. He stated the road is <br />critical to the safety of Cox Mill Road Elementary School and to the other <br />development in that area. <br /> <br />St. Andrews Phase 7 Preliminar~ Plat Application - Case C01-06(S) <br /> <br /> Mr. Jonathan Marshall, Planning Services Director, presented C01-06(S), <br />the preliminary plat approval for St. Andrews Phase 7. The property is <br />located in Township 11 off Piney Church Road and will tie into other phases <br />of the St. Andrews Subdivision that have not yet been constructed. The <br />applicant, TWLS, Inc., plans to develop 35 lots on the 15.3 acres. Also, the <br />developer has a "will serve" letter from the City of Concord and the Water <br />and Sewer Authority stating that water and sewer are available to the <br />property when the mandatory restrictions are lifted. The Planning.and Zoning <br />Commission vo~ed 7-2 to approve the technical design with conditions but <br />voted 9-0 to deny the subdivision based on the adequate public facility <br />requirements for schools. <br /> <br /> Mr. Bill Cochran, Engineer for Danny Bost (developer), discussed the <br />planned access to St. Andrews Phase 7 from both Flowes Store Road and Piney <br />Church Road. He confirmed the developer's offer to donate $500.00 per lot <br />for the planned 35 lots, or $17,500.00, to address school adequacy issues. <br /> <br /> The Board again discussed concerns related to the subdivision approval <br />process and the adequate public facilities program. Issues addressed by the <br />Board included current restrictions placed on the Planning and Zoning <br />Commission in considering new subdivisions and the need for a more <br />quantitative and better measurement of what constitutes adequate public <br />facilities for. schools. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Suggs and <br />unanimously carried, the Board approved Petition C01-06(S), the preliminary <br />plat for St. Andrews Phase 7, with the following conditions: (1) that the <br />developer enters into a Consent Agreement with the County agreeing to pay <br />$500.00 per lot to advance adequacy of school capacity; and (2) that the <br />developer must be able to obtain approved water and sewer plans and service <br />guarantees prior to any final plat approval. Further, the Board authorized <br />the County Manager to execute the Consent Agreement on behalf of the County. <br /> <br /> The Board by consensus agreed to further discuss the adequate public <br />facilities program and school construction needs at the work session on <br />December 3. <br /> <br />Proposed Data Cabling Pro~ect for the Clerk of Court - Steve Hicks~ Assistant <br />ITS Director <br /> <br /> Mr. Steve Hicks, Assistant Director of Information Technology Services, <br />reported on the poor condition of the cabling infrastructure in the County <br />Courthouse. He asked the Board to reconsider the project originally requested <br />by the Clerk of Court on November 5 and include professional design services <br />and installation of a new voice/data network infrastructure in the <br />Courthouse. <br /> <br /> Mr. John Day, Deputy County Manager for Operations, reported the total <br />project cost (first and second floors of the Courthouse) for the design and <br />installation of new infrastructure and demolition of existing cabling is <br />estimated at approximately $49,000.00. Further, Mr. Day stated he had been in <br />contact with the State and that they do want to .improve their infrastructure <br />with the County to pay for it. <br /> <br /> <br />
