<br />and Adoption of Budqet Amendment
<br />
<br /> UPON MOTION of Commissioner Casper, seconded by Commissioner Privette and
<br />unanimously carried, the Board approved the following Service Agreement with
<br />the Cabarrus County Schools and adopted the following budget amendment.
<br />
<br /> SERVICE AGREEMENT
<br /> FOR
<br /> NORTH CAROLINA SPECIAL OLYMPICS
<br />IN CABARRUS COUNTY, NORTH CAROLINA
<br />
<br /> THIS AGREEMENT, effective January 1, 2000, between Cabarrus County
<br />Schools ("Schools"), whose mailing address is Post Office Box 388, Concord,
<br />NC 28026-0388, and Cabarrus County, North Carolina, a political subdivision
<br />of the State of North Carolina (herein known as the "County") whose mailing
<br />address is Post Office Box 707, Concord, NC 28026-0707.
<br /> WHEREAS, the parties have a common interest in the North Carolina
<br />Special Olympics for the County residents (hereafter the "Program") and the
<br />health and well being of exceptional population of the County; and
<br /> WHEREAS, the parties desire to provide for the continued administration
<br />of the Program throughout the County;
<br /> NOW THEREFORE, in consideration of the premises and other good and
<br />valuable consideration, the parties hereby agree to the following terms and
<br />conditions:
<br /> 1. Administration of Program. The Program has historically been
<br />administered by the Cabarrus County Parks and Recreation Department (the
<br />"Department") and will be henceforth administered by the Schools.
<br /> 2. Term. The initial term of this Agreement is five (5) years
<br />beginning January 1, 2000 and ending June 30, 2005. The parties may renew
<br />this agreement for a five (5) year period beginning July 1, 2005, upon
<br />notification in writing by either party to the other by May 1, 2005. Terms
<br />of any renewal will be agreed and entered into by the fifteenth day of June,
<br />2005.
<br /> COUNTY OBLIGATIONS
<br /> 1. Records. The County will provide the Schools with all past
<br />records, products and equipment (which includes one computer) used by the
<br />County for the Program, including without limitation, any supplies, files,
<br />forms, awards, notebooks, video tapes, banners, games, equipment and other
<br />miscellaneous materials pertaining to the Program in the possession of the
<br />County. The County will arrange for the Schools to obtain the software
<br />computer program (Microsoft Access Data Base) used by the County to enter and
<br />produce needed items for the Program.
<br /> 2. Advertising. The County will allow the Schools access to certain
<br />Program advertising vehicles reasonably available to the County, including
<br />providing access to the County governmental access channel (currently Channel
<br />25 on Time Warner Cable).
<br /> 3. Notification. The County will notify all other local
<br />governmental agencies (i.e., ARC of Cabarrus County, Piedmont Rehabilitation
<br />Development Center, YMCA, Cabarrus Workshop, Cabarrus County Group Homes,
<br />Concord Parks and Recreation Department, and any other departments within the
<br />County structure) that have historically participated in the Program of the
<br />change in administration of the Program and shall reasonably assist the
<br /> Schools in soliciting their continued support, both physically and
<br />monetarily.
<br /> 4. Compensation. The County will compensate the Schools for its
<br />services hereunder a sum of Twenty-Four Thousand Dollars ($24,000.00) per
<br />year, for each of the five (5) years of the Initial Full Term (for a six
<br />month term - January 1, 2000 through June 30, 2000, Cabarrus County will
<br />compensate Schools for twelve thousand dollars ($12,000) in advance for these
<br />services). The fee for each fiscal year will be paid in advance to the
<br />Schools on or before July 15 of each respective year. However, in the event
<br />this Agreement is terminated during a fiscal year by the Schools, the Schools
<br />shall promptly reimburse the County for any unused fees on a prorata basis.
<br />In any year during the term of this agreement, if it should appear that the
<br />annual compensation is insufficient for the operation of the program, then
