C. General <br />Statute 143-318.11(a) (5) <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette and <br />unanimously carried, the Board moved to go into closed session as authorized <br />by North Carolina General Statute 143-318.11(a) (5) to establish, or to <br />instruct staff concerning the position to be taken by or on behalf of the <br />Board in negotiating the price or other material terms of a contract for the <br />acquisition of real property. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Barnhart and <br />unanimously carried, the Board moved to adjourn the closed session. <br /> <br />Property Acquisition Issues <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette and <br />unanimously carried, the Board authorized the issuance of a Notice of Action <br />to institute condemnation proceedings to acquire 19.10 m/- acres identified <br />as Tax Parcel 4681-06-6340 and owned by the heirs of Leondias Davidson at a <br />tax value of $58,450.00 for the entire tract. The purpose for which the <br />property is to be condemned is to expand and enhance the facilities available <br />for the education of children of Cabarrus County, and for the recreation of <br />the public, specifically for a new school and/or park facility tentatively <br />identified as the new Odell Elementary/Middle School Project. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette and <br />unanimously carried, the Board authorized the issuance of a Notice of Action <br />to institute condemnation proceedings to acquire 22 +/- acres of property on <br />the west side of Cox Mill Road, identified as part of Tax Parcel 4680-16-7368 <br />and owned by Cox Mill LLC, at a per unit value of $7,000.00 per acre. The <br />purpose for which the property is to be condemned is to expand and enhance <br />the facilities available for the education of children of Cabarrus County, <br />and for the recreation of the public, specifically for a new school and/or <br />park facility tentatively identified as the Cox Mill Elementary Project. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Carpenter and <br />unanimously carried, the Board authorized the issuance of a Notice of Action <br />to institute condemnation proceedings to acquire 22 +/- acres of property on <br />the east side of Cox Mill Road, identified as part of Tax Parcel 4680-52-5626 <br /> <br /> <br />
