414 <br /> <br />Award of Bid for Harrisburq School/Park Athletic Fields Gradinq Project to <br />the Low Bidder, McWhirter Gradinq ($95,555.25) <br /> <br /> The following bids were received on March 16, 2000 for the Harrisburg <br />School Park Athletic Fields Grading Project. Only two bids were received at <br />the initial bid opening on March 6; therefore, the bid was readvertised. <br />Concord Engineering and Surveying published the appropriate "Readvertisement <br />- Notice to Contractors" in THE INDEPENDENT TRIBUNE. <br /> <br />Foster Grading Company <br />McWhirter Grading Company <br /> <br />$105,054.40 <br />$ 95,555.25 <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Chairman Fennel and <br />unanimously carried, the Board awarded the grading bid for the Harrisburg <br />School Park Athletic Fields to the iow bidder, McWhirter Grading Company, in <br />the amount of $95,555.25 as recommended in a Memorandum dated March 16, 2000 <br />by Mr. Steve L. Little, Parks and Recreation Director, and authorized the <br />County Manager to execute the contract on behalf of Cabarrus County. <br /> <br />NEW BUSINESS <br /> <br />Zoninq Atlas Amendment Petition C00-02(R) - Petition by Robert Burkett to <br />Rezone Approximately 446 Acres of Property - Public Hearinq - 6~30 p.m. <br /> <br />Petition C00-02(R). Robert Burkett, PIN part of 4681-58-6081, <br />4681-48-1531, 4681-17-4946, 4681-15-3364, 4681-36-1154, 4681-29- <br />7610, 4681-29-5858, and 4671-95-9695. Approximately 446 acres <br />located north of Harris Road, south of HWY. 73, east of the Rocky <br />River, and west of Odell School Road. Request to rezone property <br />from LDR, Low Density Residential to HDR-SU, High Density <br />Residential Special Use and GC, General Commercial, for the <br />purpose of developing a mixed use project comprised of single and <br />multi-family residential, office/retail, and County school <br />facilities. <br /> <br /> Chairman Fennel opened the public hearing for Petition C00-02(R). The <br />Notice of Public Hearing was published in THE INDEPENDENT TRIBUNE on March <br />10, 2000 and in THE CHARLOTTE OBSERVER (Cabarrus Neighbors) on March 12 and <br />19, 2000. The Petition was a Special Use rezoning, and Chairman Fennel asked <br />the County Attorney to affirm those persons who wished to address the Board <br />during the public hearing. <br /> <br /> Mr. Hartsell and the Clerk affirmed those persons who indicated they <br />wished to address the Board regarding the Petition. Prior to addressing the <br />Board, each speaker confirmed that he/she had been previously sworn or <br />affirmed. <br /> <br /> Mr. Jonathan Marshall, Planning Services Director, presented Petition <br />C00-02(R) by Mr. Robert Burkett to rezone approximately 403 acres, including <br />two school sites, to High Density Residential Special Use (HDR-SU) and <br />approximately 43 acres to General Commercial (GC). He presented a map <br />showing the location of the property using Rocky River, Highway 73, Odell <br />School Road and the existing Odell Elementary School as points of reference. <br />The Planning and Zoning Commission voted 5-4 on February 17, 2000 to <br />recommend denial of the petition. Since the vote was not a 75 percent <br />majority, the petition was automatically brought to the Board for <br />consideration. Mr. Marshall presented the general staff review and addressed <br />the following issues associated with the rezoning: school capacity, traffic <br />implications and quality of life for area residents. He stated it was <br />staff's opinion that Mr. Burkett's offer of two school sites along with <br />additional considerations would sufficiently address the school adequacy <br />issues. Mr. Marshall reported that a traffic impact analysis performed by <br />Kubilins Transportation Group had identified a number of transportation <br />improvements that Mr. Burkett had agreed to construct as a condition of the <br />rezoning. He explained that these improvements along with the mixed uses in <br />the development would lessen the impacts of the overall development. Further, <br />Mr. Marshall stated the general area of the rezoning is changing due to the <br />construction of a major sewer line and the approval of a number of <br />developments in the area, including the Booe-Untz development, Skybrook and <br />Highland Creek. He reported that Mr. Burkett had agreed to cap the number of <br />residential units in the development at 1,670. Under the current zoning, 930 <br />units could be constructed. In conclusion, Mr. Marshall stated that staff <br />recommended approval of the development as in their opinion it is consistent <br />with development patterns in the area and the applicant has met or mitigated <br />major issues associated with the proposed project. <br /> <br /> <br />
