425 <br /> <br />Joint Session with the Planninq and Zoninq Commission <br /> <br /> The following members of the Cabarrus County Planning and Zoning <br />Commission joined the Board of Commissioners for discussion: Chairman Ed <br />Hill and Members Aaron Ritchie, Tom Dwiggins, Stephen Love, Carl Hill, Rusty <br />Drye, Bill Babb, Carl Hobbs, Dewey Moose and Martha Kiker. <br /> <br /> Chairman Fennel stated the purpose of the joint meeting was to discuss <br />the relationship between the Board of Commissioners and the Planning and <br />Zoning Commission. He thanked the Planning and Zoning Commission for the <br />work that they do for Cabarrus County. <br /> <br /> There was lengthy discussion by the County Commissioners, Planning and <br />Zoning Commissioners and Staff regarding a number of planning and zoning <br />issues. Discussion centered on adequate public facility issues, including <br />the following: $500.00 per dwelling unit to address public facility needs <br />rather than a fee based on a percentage of the value of a new home; the need <br />for adequate roads and schools in the county; the current process for <br />addressing adequate public facility issues; the possible transfer of <br />authority from the County Commissioners to the Planning and Zoning <br />Commissioners to address adequate public facility issues; the development of <br />a ~consent agreement" related to adequate public facilities to be included in <br />the approval process by the Planning and Zoning Commission and then presented <br />to the Board of Commissioners for ratification; the development of a check <br />list that can be used in negotiating adequate public facility issues with <br />developers; and the possibility of advancing the adequate public facilities <br />portion of the Draft Unified Development Ordinance for consideration and <br />adoption. <br /> <br /> There was general agreement for Staff to bring forward as soon as <br />possible a revised Adequate Public Facilities Ordinance for consideration by <br />the Planning and Zoning Commission and the Board of Commissioners. <br /> <br /> Chairman Fennel proposed the establishment of an impact fee to be paid <br />at the time a new house is occupied or sold. Mr. Marshall briefly addressed <br />legal issues associated with impact fees and the determination of those fees. <br />After discussion, a majority of County Commissioners and Planning and Zoning <br />Commissioners indicated by a show of hands their support of pursuing <br />authority to assess impact fees in Cabarrus County. Staff will prepare a <br />resolution for the Board's consideration stating the County's desire to have <br />the North Carolina General Assembly grant Cabarrus County authority to assess <br />impact fees on new homes. <br /> <br />Adjournment <br /> <br /> There being no further business to come before the Board, Chairman <br />Fennel adjourned the meeting at 9:15 p.m. <br /> <br />Clerk to the Board <br /> <br /> <br />
