554 <br /> <br /> UPON MOTIO~ of Commissioner Privette, seconded by Commissioner Casper <br />and unanimously carried, the Board approved the purchase of property located <br />at 150 South Loop Road, Kannapolis, from Central Distributing Company, Inc. <br />at a purchase price of $245,000.00. Further, the Board authorized the <br />Chairman to sign the "Agreement for Purchase and Sale of Real Property" <br />between the County and Central Distributing and to sign the "Dual Agency <br />Agreement" among the County, Central Distributing Company, Inc., and Morgan <br />Realtors whereby the Seller will pay the real estate commission. <br /> <br />Review of the Unified Development Ordinance <br /> <br /> Mr. Jonathan Marshall, Planning Services Director, distributed a list <br />of issues and/or recommended changes concerning the proposed Unified <br />Development Ordinance (UDO). <br /> <br /> Mr. Rodger Lentz, Senior Planner, highlighted the following issues for <br />which there had been questions and/or concerns. <br /> <br />Article 1 <br />Section 1.6.4.1: Allows the administrator to withhold permits <br />from an applicant if that person has outstanding repeat <br />violations on the project in question or another project within <br />Cabarrus County. Staff feels this provides a very good incentive <br />for the person involved to correct repeat violations to such <br />provisions as erosion control regulations. <br /> <br />Article 3 <br />Section 3.1.9.5: Neighborhood meetings are working very well in <br />Kannapolis and the City of Charlotte. (Charlotte was required to <br />add them to their process through their special legislation for <br />rezoning procedures). Staff feels that these meetings will <br />reduce conflict at public hearings and produce better development <br />proposals. <br /> <br />Section 3.2.5.2.6: Performance securities should have partial <br />releases. Staff feels that this would be a reasonable approach. <br />Other jurisdictions have objected to this approach. <br /> <br />Article 4 <br />Table 4.7-1: AG densities are too low and may devalue property. <br />This standard already matches the adopted policy within the Rimer <br />Overlay District. <br /> <br />Section 4.7-1: Impervious Surface Ratio Low on RV, RC, B-i, C-I, <br />O-I, C-2. C-2 was changed from 70% to 80% coverage. <br /> <br />Article 6 <br />Section 6.3.7.2: The two week time period for final plat review <br />and approval will permit land records time to digitize each new <br />subdivision so that the addressing, tax, and building permit <br />process can operate more efficiently and accurately. <br /> <br /> The Board discussed each of the issues presented by Mr. Lentz. Board <br />members made no suggested changes to the listed items. <br /> <br /> Mr. Mike Downs, Development Services Director, discussed home <br />occupations and rural home occupations. He explained that home occupations <br />take place within the home and rural home occupations allow the use of an <br />accessory building. He compared the various districts allowing home <br />occupations and rural home occupations and reviewed the types permitted and <br />the general standards for each. <br /> <br /> After discussion, the Board generally agreed to the following changes <br />to the home occupation provisions: (1) permit pet shop/grooming (enclosed) <br />and barber/beauty shop as home occupations to conform with existing <br />regulations; (2) clarify the use of flammable materials in compliance with <br />the Fire Code; (3) extend the time for visits, deliveries and pickups from <br />6:00 a.m. to 10:00 p.m.; and (4) strike the provision limiting visits to six <br />clients/day. In addition, the Board by consensus agreed to the following <br />changes relative to rural home occupations: (1) Add permitted with standards <br />in the following four districts with a minimum lot size of two acres: <br />Residential Medium Density (RM1), Residential Medium Density (RM2), Rural <br />Estate District (RE) and Residential Low Density (RL); (2) remove requirement <br />for "indoor only" from Building Contractor Storage Yard/Office; (3) delete <br />provision limiting outdoor storage to 80 square feet; (4) delete provision <br />limiting outdoor storage of stacked material to 4 feet; and (5) reduce the <br /> <br /> <br />
