Fennel, Vice Chairman <br /> Cabarrus County Board of Commissioners <br /> <br />Resolution A11owinq Piedmont Area M~/MR/SA Authority to Acquire Title to Real <br />Property <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner <br />Carpenter and unanimously carried, the Board adopted the following <br />Resolution. <br /> <br /> 'Resolution No. 1999-20 <br /> RESOLUTION ALLOWING <br /> PIEDMONT AREA MH/MR/SA AUTHORITY <br />TO ACQUIRE TITLE TO REAL PROPERTY <br /> <br /> BE IT RESOLVED by the undersigned County Commissioners of Cabarrus <br />County, North Carolina, pursuant to North Carolina General Statute 122C-147, <br />that Piedmont Area MH/MR/SA Authority, dba Piedmont Behavioral Healthcare, is <br />hereby authorized to hold legal title to real property, is granted the <br />authority to acquire the same and utilize it consistent with the applicable <br />laws and regulations of this state regarding the same. <br /> This Resolution shall become effective and binding if, and only if, the <br />consent of each and every Board of County Commissioners in the service <br />catchment area of Piedmont Area MM/MR/SA Authority likewise executes an <br />identical Resolution to this, said counties being Cabarrus, Stanly, Union and <br />Rowan. <br /> Further, this Resolution is also conditioned, as by law required, that <br />in the event Piedmont Area MH/MR/SA Authority, dba Piedmont Behavioral <br />Healthcare, was to dispose of real property acquired by the Resolution herein <br />stated, and all proceeds of such sale, including any profits generated, would <br />become the sole and exclusive property of Piedmont Area MH/MR/SA Authority, <br />dba Piedmont Behavioral Healthcare, to be utilized by the Area Board of <br />Directors of the Authority for the purposes of providing mental health/mental <br />retardation/substance abuse/developmental disabilities services in the <br />catchment area. In the event that Piedmont Area MH/MR/SA Authority, dba <br />Piedmont Behavioral Healthcare was to cease to exist, then all real estate <br />acquired pursuant to this Resolution would be sold in a commercially feasible <br />manner, and all net proceeds generated from said sale would then be <br />distributed jointly to the counties in the services catchment area of <br />Piedmont Area MH/MR/SA Authority, dba Piedmont Behavioral Healthcare, based <br />upon their percentage of population to the service catchment area as a whole. <br /> Further, this Resolution only affects future capital projects and is <br />not intended to impact any facilities the County has built for Piedmont Area <br />MH/MR/SA Authority, dba Piedmont Behavioral Healthcare, will not proceed with <br />any capital project in any county without the close consultation and approval <br />of the appropriate Board of Commissioners regarding all aspects of a capital <br />building project. <br /> Adopted this the 18tn day of October, 1999. <br /> <br /> _/s/ Arne L. Bonds, Clerk to the Board <br /> <br />Approval of Land Use Aqreement between the Harrisburq Youth Association, <br />Cabarrus County and the Cabarrus County Board of Education for Harrisburq <br />School/Park <br /> <br /> Mr. John Day, Deputy County Manager for Operations, briefly reviewed <br />the proposal by Harrisburg Youth Association to purchase 1.7 acres of land <br />adjacent to the new Harrisburg Elementary School property. The Association <br />plans to purchase the property at a cost of $41,320.00 over a period of five <br />years and then donate the land to the Cabarrus County Board of Education. <br />This 1.7-acre tract will allow the development of a four-field athletic <br />complex on the Harrisburg School/Park site. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Vice Chairman Fennel <br />and unanimously carried, the Board approved the following "Land Use <br />Agreement" between Harrisburg Youth Association, Cabarrus County and the <br /> <br /> <br />
