551 <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Mills and <br />unanimously carried, the Board approved Petition C98-Ol(T) and adopted the <br />following Ordinance amending the Cabarrus County Zoning Ordinance. <br /> <br />Ordinance No. 1998-07 <br /> <br />Petition C98-01(T) <br /> AN ORDINANCE AMENDING THE CABARRUS COUNTY <br /> ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby <br />amended as follows: <br /> <br />Amend Chapter 3, Section 3-8 Table of Permitted Uses. Add single- <br />family detached residential and Mobile Home, Class I as a <br />Conditional Use in both General Commercial and Limited Industrial <br />Zones. <br /> <br />Amend Chapter 8, Section 8.4 Conditional Uses. Add as Conditional <br />Use number 26: <br />Single Family Residential and Mobile Home, Class I <br />Zones in which conditional <br />General Commercial and Limited Industrial. <br /> <br />Single-family residences and Class I manufactured homes are <br />permitted on a hardship basis if the following conditions can be <br /> <br />met: <br />1. <br /> <br />No more than two additional homes may be added to parcels less <br />than ten acres in size. Parcels greater than ten acres may <br />not exceed 1 dwelling unit/5 acres. <br />Applicant must prove some form of hardship that has brought <br />about the request. <br />Preference shall be given to homes that may be relocated when <br />the property is developed for non-residential purposes. <br />Dwelling unit sites must be screened from adjacent non- <br />residential uses using a level one bufferyard. <br /> <br />Adopted this the 16th day of March, 1998 by the Cabarrus County <br />Board of Co~nissioners. <br /> /s/ Sue B. Bonds Board of Commissioners <br />Clerk to the Board <br /> <br />Presentation Concerning the Proposed Incorporation of the Rimertown Community - <br />Mr. Terry Barbee and Mr. Rusty Drye <br /> <br /> Mr. Terry Barbee advised the Board of the plans by residents of the Rimer <br />community to petition the General Assembly for incorporation. He stated it is <br />their intent to preserve the history and heritage of Rimertown and to be an <br />exemplary township for Cabarrus County. According to Mr. Barbee, a group of <br />residents have begun the necessary steps for incorporation and plan to submit the <br />paperwork to the General Assembly for consideration in the 1999 session. He <br />asked for a resolution by the Board endorsing the community's efforts to <br />incorporate. <br /> <br /> There was lengthy discussion by the Board regarding the requirements by the <br />North Carolina General Assembly for residents to seek incorporation and the <br />Board's role in the community's efforts to incorporate. <br /> <br /> UPON MOTION by Commissioner Mills, seconded by Commissioner Barnhart and <br />unanimously carried, the Board directed staff to prepare a resolution for <br />consideration at the next meeting endorsing the rights of the citizens of the <br />Rimer community to pursue the incorporation of Rimertown through the process as <br />outlined in the North Carolina General Statutes. <br /> <br />Approval of Contract with Alley, Williams, Carmen and King, Inc. for the <br />En~ineer.~n~ and Design of the Corban Avenue Parking Lot Project ($17,450) <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Commissioner Barnhart with <br />Commissioners Mills, Barnhart and Niblock and Chairman Casper voting for and <br /> <br /> <br />
