Adoption of Zoning Text Amendment Petition C98-02(T) Flexible Front <br />Setbacks for the Medium Density Residential District's Customized Development <br />Standards (Public Hearing for Proposed Amendment Was Held on June 15, 1998) <br /> <br /> Mr. Lagano reviewed Petition C98-02(T). At the conclusion of the public <br />hearing on June 15, the Board chose the suggested option to allow the <br />developer to use flexible front setbacks for a percentage of the property <br />while maintaining the 30-foot front setback for the remainder of the <br />development. The proposed amendment specified that 50 percent of the lots be <br />allowed front flexible setbacks. <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Commissioner Niblock and <br />unanimously carried, the Board approved Petition C98-02(T) as submitted and <br />adopted the following Ordinance. <br /> Ordinance No. 1998-09 <br />PETITION C98-02(T) <br /> <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br /> <br />Flexible Front Setbacks for the MDR District's Customized Development <br />Standards <br /> <br />On Monday, June 15, 1998, the Board of Commissioners passed an amendment to <br />the Zoning Ordinance providing developers some additional flexibility in their <br />subdivision design pertaining to the MDR district's customized development <br />standards. The amendments focuses on the front setbacks only. <br /> <br />From three suggestions presented to the Board, Suggestion 2 was selected as <br />follows: <br /> <br />Suggestion 2: <br />Allow the developer to use flexible front setbacks for a percentage of <br />the property while maintaining the 30' front setback for the remainder <br />of the development. <br /> <br />Although the Board supported the intent of the amendment, it did not choose <br />the specific percentage of a development that would be subject to flexible <br />front setbacks. <br /> <br />Staff's recommendation is that 50% of the lots in a given development should <br />be allowed to use flexible front setbacks while the remaining 50% of the lots <br />should be subject to the existing 30' setback requirement. The specific <br />language of the amendment as staff recommends is italicized below: <br /> <br />-FronC ... 50% flexible; 50Z 30' <br />-Side ... flexible <br />-Rear ... flexible <br /> <br />Since this amendment was already advertised and a public hearing held, <br />Board does not need to hold an additional public hearing. <br /> <br />Adopted this the 13~h day of July, 1998 by the Cabarrus County Board of <br />Commissioners. <br /> <br />ATTEST: <br />~s/ Frankie F.
