NOW COMES Cabarru$ County (the "Declarant"), under the provision of <br />N.C.G.S. 136-96, and hereby declares that the portion of Morris Road described <br />in Paragraph 2 hereinafter (the "Unopened Street Segment"), be and the same is <br />hereby withdrawn from the dedication as a public way, and in support thereof, <br />says that: <br /> <br />The Declarant is the owner of that real property located on either side <br />of and adjacent to the same Unopened Street Segment, has owned the <br />adjacent real property for a period in excess of fifteen (15) years, and <br />thereby claims the same by and through the original dedicator. <br /> <br /> The UnoPened Street Segment is more particularly described as follows: <br /> Lying and being in Number 11 Township of Cabarrus County, now or <br />formerly a portion of the City of Concord, and being a portion of the <br />recorded maps with the Cabarrus County Register of Deeds as follows: <br />Cabarrus County Home Property as recorded in Map Book 7, Page 3. <br /> <br /> BEGINNING at the southeast corner of Lot 3, Block C, of Cabarrus <br />County Home Property as recorded in Book 7, Page 3, with the Cabarrus <br />County Register of Deeds. From the point of beginning, in a <br />northeasterly direction to the right-of-way for U.S. Highway 601 Bypass, <br />a point located in the northwestern edge of Lot 10, Block C. Thence with <br />the right-of-way of U.S. Highway 601 Bypass in a southeasterly direction <br />to a point in the northwestern edge of Lot 12, Block D. Thence with the <br />southern edge of the right-of-way for Morris Road in a southwesterly <br />direction to its intersection with the right-of-way for Union Cemetery <br />Road (SR 1375).
