The facility would be <br />located on Speedway Boulevard and managed by the Tourism Authority at a date <br />in the future. Further, Mr. Shore reported the Tourism Authority Board had <br />voted to support the proposed Marriott with an incentive grant of four percent <br />(4%) of the five percent (5%) collected as their occupancy tax, granted back <br />to them for a period of five years for this project, with the additional one <br />percent (1%) being used for the land and construction of a public civic <br />center. <br /> <br /> At 7:45 P.M., Chairman Casper opened the public hearing concerning the <br />proposed increase in the room occupancy and tourism development tax from three <br />percent (3%) to five percent (5%). The Notice of the Public Hearing was <br />published in THE INDEPENDENT TRIBUNE on August 5, 1998 and THE CHARLOTTE <br />OBSERVER (Cabarrus Neighbors) on August 6, 1998. <br /> <br /> Mr. Jim Hobbs, President of the North Carolina Hotel/Motel Association, <br />reported a group of local hotel/motel owners/operators representing seven (7) <br />properties in the area met on August 5. He stated these owners/operators <br />would not oppose the occupancy tax increase if the money were used to develop <br />a civic center/exhibition type convention facility here in Cabarrus County. <br /> <br /> Mr. Sherrill Laney of Miller Road in Kannapolis stated his support of an <br />increase in the occupancy tax from three percent (3%) to five percent (5%). <br /> <br /> There was no one else present to address the Board, and Chairman Casper <br />closed the public hearing. <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Commissioner Carpenter <br />and unanimously carried, the Board adopted the following Resolution. <br /> <br />Resolution No. 1998-26 <br /> <br /> RESOLUTION INCREASING THE LEVY OF THE ROOM OCCUPANCY <br /> AND TOURISM DEVELOPMENT TAX FROM THREE PERCENT (3%) <br /> TO FIVE PERCENT (5%) AND PRESCRIBING THE METHOD <br />OF DISTRIBUTION OF THE PROCEEDS WITHIN CABARRUS COUNTY <br /> <br /> WHEREAS, a public hearing was held on August 17, 1998, to consider <br />increasing the levy of a room occupancy and tourism development tax for <br />Cabarrus County from three percent (3%) to five percent (5%), and interested <br />citizens presented their views to the Board of County Commissioners of Cabarrus <br />County; and <br /> WHEREAS, the Board of County Commissioners caused public notice of the <br />public hearing to be given in accordance with law at least ten (10) days prior <br />to the date of the hearing; and <br /> WHEREAS, the Board of Commissioners of Cabarrus County is now of the <br />opinion and does hereby find and declare that increasing the levy of the room <br />occupancy and tourism development tax within Cabarrus County, North Carolina, <br />from three percent (3%) to five percent (5%) is both desirable and necessary to <br />adequately finance the operation of the Cabarrus County Tourism Authority; <br /> NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of <br />Cabarrus County as follows: <br /> Section 1. There is hereby imposed and levied within Cabarrus County, <br />North Carolina, a five percent (5%) room occupancy and tourism development tax <br />authorized by ratified Chapter 658 of the 1989 Session Laws (Regular Session, <br />1989), effective July 19, 1989. The tax hereby imposed and levied shall apply <br />to the same extent and be subject to the same limitations as are set forth in <br />said ratified Chapter and Section 70-31 of the Code of Ordinances of Cabarrus <br />County be and the same is hereby amended consistent herewith. <br /> Section 2. Collection of the tax by the Cabarrus County Finance Officer, <br />and liability therefor, shall begin and continue on and after the 1"t day of <br />October, 1998. <br /> Section 3. The net proceeds of the tax levied herein, i.e. the gross <br />proceeds less five percent (5%) of the amount collected, shall be distributed <br />by the Cabarrus County Finance Officer to the Cabarrus County Tourism <br />Authority, or otherwise, on a monthly basis as prescribed by said enabling <br />legislation. <br /> Section 4.
