281 <br /> <br /> The Board of Coxmissioners of Cabarrus County, North Carolina <br />do ordain as follows: <br /> <br /> That no zoning permits shall be issued for the construction of <br />new cellular and/or PCS communication towers for a period of 90 days <br />beginning on the date of adoption of this ordinance so that the <br />Planning and Zoning staff may draft changes to the existing <br />regulations to better protect the health, safety, and welfare of the <br />citizens of Cabarrus County. <br /> <br /> Adopted this the 21st day of April, <br />County Board of Commissioners. <br /> <br />ATTEST: <br />/s/ Frankie F. Bonds, Clerk to the Board <br /> <br />Zoning Atlas Amendment (Petition 97-05) - Public Hearing - 7:00 P.M. <br /> <br />Petition 97-05. Carroll Mullis, Petitioner, Map/PIN 5633-02-6402, <br />approximately 8.7 acres off Horseshoe Circle near 1-85. Wish to <br />rezone from Medium Density Residential to Low Density Residential - <br />Special Use, to permit a double wide mobile home on the property. <br /> <br /> Mr. Marshall advised that Petition 97-05 was a Special Use request and <br />would require sworn or affirmed testimony. <br /> <br /> Mr. Hartsell affirmed Mr. Marshall and Mr. Ron Anthony. Also, he later <br />affirmed Mr. Ed Hill, Chairman of the Planning and Zoning Cemmisston. <br /> <br /> Mr. Marshall presented the rezoning request by Mr. Carroll Mullis, <br />including location of the property, findings and compatibility with other <br />ordinances, and the staff analysis. The Planning and Zoning Commission <br />previously granted the Petitioner an exception to the Subdivision Regulations to <br />divide the property and use a 15-foot right-of-way for access. Stating the <br />proposed use is in keeping with the development in the area, Mr. Marshall <br />reported that staff recommended approval of the petition. <br /> <br /> Mr. Hill advised that the Planning and Zoning Commission found the staff <br />recommendation to be in order and approved the rezoning request on March 20. <br /> <br /> Chairman Casper opened the public hearing at 7:25 P.M. on Petition 97-05 <br />and asked if anyone were present who wished to address the Board regarding this <br />rezoning request. <br /> <br /> Mr. Ron Anthony, resident of Horseshoe Circle, presented the following <br />concerns regarding the rezoning request: (1) Other uses that will be allowed on <br />the property; (2) Placement of 16 vehicles on the property; (3) Placement of a <br />storage trailer on the property in 1994; and (4) Inaccurate date in the <br />notification letter for the Planning and Zoning Commission meeting. <br /> <br /> Mr. Marshall responded to Mr. Anthony's concerns. (1) The Special Use <br />rezontng will limit Mr. Mullis to the placement of two mobile homes without going <br />through another rezoning process; (2) Staff will pursue the issue of the 16 <br />vehicles as a zoning complaint; (3) The Zoning Administrator and Chief Building <br />Inspector have ruled that mobile homes can be used as storage units if they are <br />modified to prohibit future use as a dwelling unit; (4) Property owners were <br />renotified and a public hearing scheduled before the Board of Commissioners as <br />a result of the inaccurate notification letter. <br /> <br /> Mr. Hill advised that the Planning and Zoning Commission was not aware of <br />the number of vehicles on the property prior to approval of the rezoning request. <br /> <br /> Chairman Casper clarified with Mr. Anthony that he was not in opposition <br />to the rezoning issue itself but wanted to protect the visual aspects of his <br />property. Mr. Anthony indicated that this was correct. <br /> <br /> Commissioner Barnhart read the following findings of fact into the record <br />and moved for approval of Petition 97-05 by Carroll Mullis to rezone <br />approximately 8.7 acres (Map/PIN 5633-02-6402) off Horseshoe Circle from Medium <br /> <br /> <br />
