370 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session in the Commissioners' Meeting Room at the Cabarrus County Governmental <br />Center in Concord, North Carolina on Monday, September 15, 1997, at 6:30 P.M. <br /> <br />Present - Chairman: Sue B. Casper <br /> Vice-Chairman: Carolyn B. Carpenter <br /> Commissioners: Jeffrey L. Barnhart <br /> Kenneth Mills <br /> Franklin C. Niblock, Jr. <br /> <br /> Also present were Mr. Fletcher L. Hartsell, Jr., County Attorney; Mr. John <br />Day, Deputy County Manager; and Mrs. Frankie F. Bonds, Clerk to the Board. <br /> <br />Chairman Casper called the meeting to order at 6:30 P.M. <br /> <br /> Scouts Josh Barrier and Derek Heintz from Troop 59 of the New Gilead United <br />Church of Christ conducted the Flag Ceremony. <br /> <br /> The invocation was given by Reverend David Woodard of the Wil-Mar Park <br />Baptist Church. <br /> <br />Approval or Correction of Minutes <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Mills and <br />unanimously carried, the minutes of August 12 and September 4, 1997 were approved <br />as written. <br /> <br />Approval of the Agenda <br /> <br /> Chairman Casper asked that the following provision be added to Consent Item <br />3 relative to the tower construction bid award: "subject to the finalization of <br />a lease between Cabarrus County and the Cabarrus County Board of Education." <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Mills and <br />unanimously carried, the Board tabled Consent Item 12 (Adoption of Revisions to <br />Solid Waste Management Ordinance) until the next Board meeting. <br /> <br />CONSENT AGENDA <br /> <br />Adoption of Ordinance Extending the Current Cable Television Franchise and <br />Increasing Franchise Fee to Five Percent ~5%~ (FY 1997-98 Budget Proposal) - <br />Second Readin~ <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Mills and <br />unanimously carried, the Board adopted the following Ordinance on second reading. <br /> <br />Ordinance No. 1997-11 <br /> <br /> ORDINANCE EXTENDING THE <br />CABLE TELEVISION FRANCHISE ORDINANCE <br /> <br /> WHEREAS, Time Warner Cable holds a franchise to provide cable <br />television service for Cabarrus County; and <br /> WHEREAS, negotiations on a new franchise agreement are <br />continuing between Time Warner Cable and Cabarrus County; and <br /> WHERFAS, Time Warner General Manager Bob Melton has agreed to <br />an extension of the current cable television franchise issued to <br />Time Warner Cable with a franchise fee of five percent (5%) of gross <br />revenues. <br /> NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners <br />of the County of Cabarrus that: <br /> 1. Effective immediately, the Cable Television Franchise <br />issued to Time Warner Cable is hereby extended through December 31, <br />1997. <br /> 2. Effective October 1, 1997, the cable television <br />franchise fee will increase from three percent (3%) to five percent <br />(5%) of gross revenues. <br /> Adopted this the 15th day of September, 1997. <br /> <br /> /s/ Sue Casper <br />Sue Casper, Chairman <br />Board of Commissioners <br /> <br /> <br />
