172 <br /> <br />Request for Road Closing Scheduling a Public Hearing <br /> <br /> Mr. Hartsell presented a petition from Ernst P. and Rita S. Baumann <br />requesting that the Board close 400 feet of Forest Drive which has never been <br />opened. He asked that the Board authorize publication of the notice of public <br />hearing for the road closing. <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Niblock with <br />Commissioners Fennel and Niblock and Chairman Barnhart voting for, the Board <br />adopted the following resolution authorizing publication of a notice for a public <br />hearing to be held at 7:00 P.M. on Monday, November 18, 1996. <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />RESOLUTION DECLARING INTENT TO CLOSE <br />EASEMENTS DEDICATED FOR PUBLIC ROADS <br /> <br /> WHEREAS, at the September 16, 1996, meeting of the Board of <br />Commissioners for Cabarrus County ("the Board"), the Board <br />acknowledged receipt of a Petition to adopt a resolution and order <br />closing Forest Drive (unopened) in Township 2, Cabarrus County, <br />North Carolina, as more particularly described in maps on file in <br />the Office of Land Records and/or the Office of the Register of <br />Deeds of Cabarrus County (the "Road"); and <br /> WHEREAS, pursuant to N.C.G.S. 153A-241, it is the intention of <br />the Board to conduct a public hearing to close the Road; and <br /> WHEREAS, the Board desires to notify the public regarding said <br />public hearing on the issue of closing the Road. <br /> <br />BE IT THEREFORE, RESOLVED THAT: <br /> 1. A meeting and public hearing on the closing of Forest <br />Drive (unopened), Township 2, Concord, North Carolina shall be held <br />before the Board at 7:00 P.M. on the 18th day of November, 1996, or <br />as soon thereafter as persons may be heard. <br /> 2. This resolution declaring the Board's intent to close an <br />easement dedicated for a public road be published in The Concord <br />Tribune on Monday, October 21 and 28 and November 4 and 11, 1996, <br />and be prominently posted on at least two (2) places along the <br />Road. <br /> 3. At said hearing, the Board shall hear all interested <br />persons who appear with respect to whether the closing will be <br />detrimental to the public interest or to any individual property <br />rights. <br /> This the 16th day of September 16, 1996. <br /> <br />ATTEST: <br /> /s/ Frankie F.
