2O5 <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Mills with <br />Commissioners Fennel, Mills and Casper voting for and Chairman Barnhart and <br />Commissioner Niblock voting against, the Board voted to send a letter to the <br />Concord Planning and Zoning Commission stating that we have discussed the <br />appointment with Mr. Littlefield and discovered the misunderstanding concerning <br />the attendance rules for an alternate and have ascertained his desire to continue <br />to serve on the Planning and Zoning Commission; therefore, we ask the Concord <br />Planning and Zoning Commission to reconsider their decision and reinstate Mr. <br />Littlefield for the remainder of his term. <br /> <br />Resolution Concerning Protection of Parental Rights Over Care and Education of <br />Their Children - Commissioner Fennel <br /> <br /> Commissioner Fennel presented a proposed '~Resolution Concerning Protection <br />of Parental Rights Over Care and Education of Their Children" and presented <br />'%dditional Information and Facts" regarding the proposed Resolution. He moved <br />for the adoption of the following Resolution. <br /> <br /> Resolution Concerning <br />Protection of Parental Rights Over <br />Care and Education of Their Children <br /> <br /> Whereas, it is understood that the law of North Carolina gives <br />the Department of Social Services (DSS) the right, at taxpayers <br />expense, to enter a public school for the purpose of interviewing <br />children, without the knowledge and consent of their parent(s) and <br />without the presence of school administrators in whose care and <br />safety the parents have placed their children. <br /> And Whereas, DSS from another county without notification to <br />the Cabarrus County DSS entered on Thursday, November 7th a private <br />school in Cabarrus County in violation of our constitution and <br />certain parental authority and rights to interrogate three children <br />under false, libelous and anonymous information. The DSS <br />investigator, furthermore, refused to let school administrators of <br />the children notify the parents of the children. And only by the <br />brave action of their thirteen year old son were the parents <br />notified of this government trampling on their parental authority. <br /> Therefore, Be It Resolved, that in Cabarrus County the <br />Department of Social Services (from within the county or not) <br />understand that they are prohibited from entering a private school <br />building to interview (interrogate) any children without either the <br />parents written consent or a criminal court order. Also, that <br />private school officials be directed to protect the children under <br />their temporary supervision and care from any governmental or other <br />force that seeks to abuse the God given rights of the parent in <br />educating and caring for their children. <br /> Be It Further Resolved, that should the DSS investigator have <br />the written consent of the parent(s) or a criminal court order, then <br />an official of the private school must be present during the <br />interview acting on behalf of the parent in protection of the child <br />during the interview of the child. <br /> Be It Further Resolved, that a copy of this resolution be sent <br />to our legislative delegation so that they may review the law in <br />North Carolina to eliminate this violation of basic parental rights <br />and authority in the public schools. And that, a copy be sent to <br />all other county commissions in the state, so that they too may <br />address this issue within their counties. <br /> <br />The motion by Commissioner Fennel died for lack of a second. <br /> <br /> There was lengthy discussion by the Board regarding proper procedures for <br />child abuse investigations and the need to protect children from child abuse. <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Niblock with <br />Chairman Barnhart and Commissioners Niblock, Casper and Mills voting for and <br />Commissioner Fennel voting against, the Board adopted the following motion: This <br />Board declares it has reason for concern over potential intrusion by some <br />governmental agencies in the investigation of potential child abuse cases. We <br />therefore propose that our Social Services Director Jim Cook and State Senator <br />Fletcher Hartsell look into this matter and make recommendations for an effective <br />approach to the concern to be discussed at our Board work session. <br /> <br /> <br />
