.307 <br /> <br />o <br /> <br />a. limiting the size of the sign to 10 square feet as stated <br /> in the Cabarrus County Zoning Ordinance for a rural home <br /> occupation. <br /> Hours of operation will be a contributing factor to impacts on <br /> the adjoining properties. This is addressed through: <br />a. limiting the hours of business operation to regular <br /> business hours of 8:00 a.m. to 5:00 Monday through Friday <br /> and 8:00 a.m. to 12:00 or 1:00 p.m. on Saturday. <br /> Where basic vehicle maintenance may be conducted on site, the <br /> business operation shall be limited to primarily a dispatch <br /> facility. Vehicle maintenance is restricted to: <br /> a. oil and tire changes <br />In order to reduce any environmental impacts on the site and <br />adjacent properties, proper- disposal of waste material is <br />required. This is done by: <br />a. requiring owner to contract with disposal company to <br /> dispose properly of oil, tires and other waste. <br />Where it was stated in the public hearing as well as provided <br />as part of the rezoning petition, the number of trucks should <br />be limited to reduce the amount of traffic to and from the <br />site and limit the number of vehicles on site at any given <br />time. This will be done by limiting the maximum number of <br />trucks permitted on the site to 15. <br /> <br />Commissioner Fennel expressed reservations concerning Items 4(b) and Item 6 while <br />reading the list of conditions. However, upon completing the list, he questioned <br />the acceptability of the proposed conditions as presented. <br /> <br /> Commissioner Casper commented that Mr. Conner was shaking his head in the <br />affirmative in regards to the conditions as read. To clarify her motion, she <br />stated that it was her intent that all the conditions read by Commissioner Fennel <br />be included as a part of her motion. Commissioner Olio-Mills indicated that this <br />was not the intent of his second. Therefore, Commissioner Casper's motion to <br />approve Petition 94-07 with the conditions as presented died for lack of a <br />second. <br /> <br /> Commissioner Fennel made a motion to approve Petition 94-07 by Max Lee <br />Conner subject to the conditions as set forth above, with the exception of Item <br />4(b), construction of a berm, and Item 6, hours of operation. He included the <br />following findings of fact as a part of the motion. <br /> <br />The Commissioners ascertain that the Midland Area Plan, <br />although not incorrect in its presentation, is not complete <br />and lacks necessary detail in that it did not recognize the <br />existing businesses in the old Cabarrus community. Therefore, <br />we find that support of this rezoning would not be in <br />disharmony with the Midland Area Plan. <br />In supporting this rezoning, trucks will be prevented from <br />traveling along Cabarrus Station Road (SR 1121) and will be <br />kept from crossing State Bridge No. 143 over the Muddy Creek <br />as well as an unsafe railroad crossing on SR 1121. Safe <br />movement could be made through travel along Bethel Avenue <br />Extension and Wallace Road keeping truck traffic well away <br />from the primary residential areas on Cabarrus Station Road. <br />The operations manager has expressed the business will be a <br />dispatch office with no loading or unloading conducted on the <br />premises. Therefore, approval of this petition will not <br />significantly increase the intensity of the use on this or <br />adjoining properties. <br />Although discontinued, there was a prior commercial use on <br />this site and the proposed use would be adjacent to existing <br />commercial uses. <br /> <br /> The motion was seconded by Commissioner Olio-Mills. Chairman Barnhart then <br />opened the floor for comments from the Board members. <br /> <br /> Commissioner Niblock stated in his opinion the prior commercial use of this <br />property was not in compliance with zoning laws in effect at that time and that <br />the other commercial businesses in the vicinity are not similar to the business <br /> <br /> <br />
