He further commented that in his opinion the proposed <br />business is not in harmony with the existing residential area and the use of the <br />land. <br /> <br /> Commissioner Casper commented on the differing opinions of residents in the <br />community and the impact of this issue on the community. <br /> <br /> Chairman Barnhart referred to the recommendation by both the Planning and <br />Zoning staff and Planning and Zoning Commission to deny the petition. He stated <br />that three major issues were raised concerning the proposed rezoning: (1) <br />Letter from Mr. Alvin Hough of the State Department of Transportation outlining <br />safety problems with the bridge., specifically weight limits that would not <br />accommodate loaded tractor trailers; (2) Compatibility with surrounding land uses <br />and the intent of the Midland Area Plan; and (3) Spot zoning issue as included <br />in the staff analysis in regards to the General Statutes and former case law. <br /> <br /> There were no other comments. The motion by Commissioner Fennel and <br />seconded by Commissioner Olio-Mills was then approved by the following vote: <br /> <br />Voting for: Commissioners Fennel, Olio-Mills and Casper <br />Voting against: Chairman Barnhart and Commissioner Niblock <br /> <br /> The submitted development plan as modified is on file in the Planning, <br />Zoning and Building Inspection Department and incorporated herein by reference <br />as a part of the minutes. <br /> <br />NEW BUSINESS <br /> <br />Zoning Text Amendment - Public Hearing - 7:00 P,M, <br /> <br />Petition 94-08(T). Chapter 10 Parking and Loading. Existing, <br />Section 10-5(4). Specific Design Standards for Off-Street <br />Parking. Setbacks - No required off-street parking shall be <br />located within the setback areas. Proposed, Section 10-5(4). <br />Specific Design Standards for Off-Street Parking. Required <br />Setbacks for Off-Street Parking and Loading Areas - No parking <br />shall be located within the buffer yards as required in <br />Chapter 11 of this ordinance. If a buffer yard is not <br />required, no parking shall be located within ten (10) feet of <br />a side or rear property line or within ten (10) feet of the <br />front base setback line. Corner lots shall be measured as to <br />have two front base setback lines. These ten (10) feet areas <br />must be appropriately landscaped as required by this <br />Ordinance. This does not apply to single or two family <br />dwellings. <br /> <br />The Planning and Zoning Commission voted 7-0 to approve this petition. <br /> <br />Mr. Newton briefly reviewed the proposed text amendment. <br /> <br /> Chairman Barnhart opened the public hearing for Petition 94-08(T) at 7:55 <br />P.M. and asked if anyone were present who wished to speak either for or against <br />the proposed amendment.
