330 <br /> <br />RESOLUTION AUTHORIZING CONDEMNATION <br />PROCEEDINGS TO SECURE LAND <br /> <br /> ~I~EREAS, the Cabarrus County Board of Commissioners (the <br />"County"), in conjunction with the Cabarrus County Board of <br />Education (the "School Board") has previously determined and hereby <br />ratifies that it is necessary for the educational and general <br />welfare of the citizens of Cabarrus County that a new elem6ntary <br />school and/or a park with related public recreational facilities <br />(the "Westside Project") be constructed in order to promote and <br />enhance the general welfare of the County and its citizens, <br />particularly those of school-age; and <br /> ~HEREAS, the site for the Weststde Project has previously been <br />determined to be that 59.51 acre tract located on the south side of <br />Weddington Road, Cabarrus County, more particularly identified as <br />Parcel IDNumbers 5600--93-3799 and 5600-82-6891 in the office of the <br />Cabarrus County Tax Assessor (the "Weststde Project Site"); and <br /> ~EREAS, to date, the County has been unable to purchase the <br />Westside Project Site from the current owner thereof, i.e., First <br />Charter National Bank, Trustee for Lilltan M. Southerland, and has <br />determined that it is necessary to proceed expeditiously to take <br />title thereto. <br /> NOW, THEREFORE, be it RESOLVED, that Jeffrey L. Barnhart, <br />Chairman of the Board of Commissioners of Cabarrus County be and is <br />hereby authorized to execute all documents necessary to institute <br />condemnatio~ proceedings for the real property required for the <br />Westside Project, including, but not limited to, the Westside <br />Project Site; and <br /> IT IS FURTHER RESOLVED that Fletcher L. Bonds <br /> <br />BOARD OF COMMISSIONERS FOR <br />CABARRUS'COUNTY <br />By: /s/ Jeffrey L, Barnhart <br /> Chairman <br /> <br />Resolution Relative to School Financing <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Olio-Mills <br />and unanimously carried, the Board adopted the following resolution. <br /> <br /> Commissioner Chairman Barnhart introduced the following <br />resolution, a summary of which had been provided to each <br />Commissioner, which was read by title: <br /> <br />RESOLUTION DESIGNATING THE COUNTY MANAGER, <br />FINANCE DIRECTOR OR ASSISTANT FINANCE DIRECTOR TO <br />DECLARE OFFICIAL INTENT ON BEHALF OF THE COUNTY <br />TO REIMBURSE EXPENDITURES WITH PROCEEDS OF DEBT <br />PURSUANT TO UNITED STATES DEPARTMENT OF TREASURY <br />REGULATIONS <br /> <br /> BE IT RESOLVED, by the Board of Commissioners (the "Board") <br />for the County of Cabarrus, North Carolina (the "County"): <br /> Section 1. The Board hereby finds, determines and declares <br />as follows: <br /> (a) Treasury Regulations Section 1.150-2 (the <br /> "Regulations"), promulgated by the United States <br /> Department of Treasury on June 18, 1993, prescribes <br /> certain specific procedures applicable to certain <br /> obligations issued by the County after June 30, 1993, <br /> including, without limitation, a requirement that the <br /> County timely declare its official intent to reimburse <br /> <br /> <br />
