He pointed out that the Board could put <br />conditions on the special use which would benefit all the residents. Also, <br />Commisstonec Ntblock addressed the issue of other commercial zoning in the area <br />and future changes in conditional uses. <br /> <br /> Ms. LaUrie Feeney, resident of the Britley Subdivision, spoke in opposition <br />to the rezoning. ~She stated she does see Mr. Plott's property in the wintertime <br />and somewhmt during the summer. Ms. Feeney commented that the video was very <br />selective in recording the various sites of the neighborhood. She expressed <br />concern that commercial property in the area would cause the property values to <br />decrease. Stmting that current regulations are not being enforced, Ms. Feeney <br />asked what would prevent Mr.'Plott from continuing to break the rules. According <br />to Ms. Feeney, the area residents are far more in number and profit to the county <br />than Mr. Plottv.s business. <br /> <br /> Mr. David Feeney, resident of the Britley Subdivision, agreed with <br />Commissioner Olio-Mills that this is a zoning issue. In regards to Commissioner <br />NtblockVs statement, he stated that the residents have to rely on the County to <br />deny the commercial rezoning as well as protect them in the future. Mr. Feeney <br />stated that the business has doubled, if not tripled, during the past two years. <br />Also, he reported the signage has changed and the property recontoured in order <br />for Mr. Plott to eXpand the products he sells. If the rezoning is denied, Mr. <br />Feeney stated that someone from the Planning and Zoning Department should inspect <br />Mr. Plott~s property as of today and restrict Mr. Plott in his present use for <br />all future growth. He expressed concern about future commercial rezoning in the <br />area and the devaluation of his property. In conclusion, Mr. Feeney asked that <br />the Board deny the rezontng and make Mr. Plott live up to the restrictions which <br />are on his property. <br /> <br /> Ms. Vicky Wood, 20oyear resident of the area, advised that Mr.'Plott~s <br />trucks do not bother her; however, she stated that she does not want the <br />commercial zoning in the area. She suggested that the noise is not from Mr. <br />Plott~s trucks, but from trucks bringing fill material to a nearby church. Ms. <br />Wood stated the rezoning issue started as a personal vendetta and has escalated <br />since that time. She expressed concern for the "oldtimers" and other area <br />residents who do not live in the developments or have expensive homes. <br /> <br /> Ms. Dee Ward, resident of the Bradford Park Subdivision, objected to the <br />location of a commercial zone near her residence and questioned the lack of <br />enforcement of current regulations. She stated there are over 150 persons <br />present at the meeting who will help to enforce the zoning regulations. She <br />asked the Board to enforce the scope of Mr. Plott~s business as it was in 1993. <br /> <br /> Ms. Madeline L. Caesar expressed concern that the zoning regulations have <br />not been enforced and the business has expanded beyond its original scope. <br />Stating that approval of the rezoning would benchmark what is allowed and not <br />allowed, she questioned the enforcement of future regulations. <br /> <br /> Ms. Dee Ward complained that persons in the Britley subdivision have no <br />benefit of any city utilities and that the property taxes go only to the schools, <br />police and fire protection. She commented the rezoning would set a precedent and <br />would make it easier to submit rezoning requests in the future. <br /> <br /> Mr. Ed Small commented on the efforts of the Planning and Zoning Commission <br />and the Planning staff to help the property owners and Mr. Plott. He expressed <br />concern about a decrease in property values if the rezoning is approved and the <br />difficulty in enforcing the conditions recommended by the Planning staff. <br />According to Mr. Small, the residents want the best use of the land in a medium <br />density residential district with limited signage and operation of the business <br />as it was operated in 1993. He asked the Board to decide on the issue of <br />commercial zoning at this time and decide on conditions and what can be enforced <br />at a later date. <br /> <br /> In conclusion, Mr. Boger stated the residents feel it is in the best <br />interest of their neighborhood to leave the zoning as it is at the present time. <br /> <br /> Chairman Barnhart asked Mr. Howell if the petitioner agrees to the <br />conditions recommended by the Planning staff and listed by Mr. Newton earlier in <br />the meeting. <br /> <br /> <br />
